Stat. tit. 21, § 21-1023","heading":"Finding by magistrate that material is obscene or child","body":"sexual abuse materials — Issuance of factual and legal basis —\n\nDelivery to district attorney.\n\nThe magistrate to whom any child sexual abuse material, or any\n\nobscene material, is delivered pursuant to Section 1022 of this\n\ntitle, shall, upon the examination of the accused, or if the\n\nexamination is delayed or prevented, without awaiting such\n\nexamination, determine the character of such child sexual abuse\n\nmaterial or obscene material, and if the magistrate finds it to be\n\nobscene material or child sexual abuse material, the magistrate\n\nshall cause the same to be delivered to the district attorney of the\n\ncounty in which the accused is liable to indictment or trial. The\n\nmagistrate shall issue in writing the factual and legal basis for\n\nthe determination by the magistrate of the character of the child\n\nsexual abuse material or obscene material.\n\nR.L. 1910, § 2465.
