As used in Sections 1021, 1021.1 through 1021.4, Sections\n\n1022, 1023, and Sections 1040.8 through 1040.24 of this title,\n\n“child sexual abuse material” means:\n\n1. Any visual depiction of a child engaged in any act of\n\nsexually explicit conduct;\n\n2. Any visual depiction of a child that has been adapted,\n\naltered, or modified so that the child depicted appears to be\n\nengaged in any act of sexually explicit conduct; or\n\n3. Any visual depiction that appears to be a child, regardless\n\nof whether the image is a depiction of an actual child, a computer-\n\ngenerated image, or an image altered to appear to be a child,\n\nengaged in any act of sexually explicit conduct, and such visual\n\ndepiction is obscene.\n\nB. Each visual depiction or individual image of child\n\npornography shall constitute a separate item and act.\n\nC. As used in Sections 1021 through 1024.4 and Sections 1040.8\n\nthrough 1040.24 of this title:\n\n1. “Child” means a person under eighteen (18) years of age;\n\n2. “Obscene” means any performance or depiction, in any form or\n\non any medium, if the material when taken as a whole:\n\na. appeals to the prurient interest in sex as determined\n\nby the average person applying the contemporary\n\nstandards of their community,\n\nb. depicts, represents, or displays sexually explicit\n\nconduct in a patently offensive way, and\n\nc. a reasonable person would find the material or\n\nperformance lacks serious literary, artistic,\n\neducational, political, or scientific value;\n\n3. “Performance” means any display, live, recorded, or\n\ntransmitted, in any form or medium;\n\n4. “Sexually explicit conduct” means any of the following\n\nwhether actual or simulated:\n\na. acts of sexual intercourse,\n\nb. acts of oral and anal sodomy,\n\nc. acts of masturbation,\n\nd. acts of sexual activity with an animal,\n\ne. acts of sadomasochism including:\n\n(1) flagellation or torture by or upon any person who\n\nis nude or clad in undergarments or in a costume\n\nwhich is of a revealing nature, or\n\n(2) the condition of being fettered, bound, or\n\notherwise physically restrained on the part of\n\none who is nude or so clothed,\n\nf. acts of excretion in a sexual context, or\n\ng. exhibiting genitalia, breast, or pubic area for the\n\npurpose of the sexual stimulation of the viewer;\n\n5. “Explicit child sexual abuse material” means material which\n\na law enforcement officer can immediately identify as child sexual\n\nabuse material; and\n\n6. “Visual depiction” means any depiction, picture, movie,\n\nperformance, or image displayed, stored, shared, or transmitted in\n\nany format and on any medium including data that is capable of being\n\nconverted into a depiction, picture, movie, performance, or image.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"524c7df66611b07a5b9ed262b2baf273c0c7f637d3414933aec20bf3083a4cfe","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1024.1v1","next":"us-ok/okla.-stat.-tit.-21-21-1024.2"},"notice":"GroundRules: Original legal text.
