Stat. tit. 21, § 21-1031v1","heading":"Punishment for violations - Fines - Knowingly engaging","body":"in prostitution while infected with HIV - Violations within certain\n\ndistance from school or church.\n\nA. Except as provided in subsection B, C, D, or E of this\n\nsection, any person violating any of the provisions of Section 1028,\n\nparagraph 1, 2, 3, or 5 of subsection A of Section 1029, or Section\n\n1030 of this title shall, upon conviction, be guilty of a\n\nmisdemeanor and shall be punished by imprisonment in the county jail\n\nfor not less than thirty (30) days nor more than one (1) year or by\n\nfines as follows: a fine not more than Two Thousand Five Hundred\n\nDollars ($2,500.00) upon the first conviction for violation of any\n\nof such provisions, a fine not more than Five Thousand Dollars\n\n($5,000.00) upon the second conviction for violation of any of such\n\nprovisions, and a fine not more than Seven Thousand Five Hundred\n\nDollars ($7,500.00) upon the third or subsequent convictions for\n\nviolation of any of such provisions, or by both such imprisonment\n\nand fine. In addition, the court may require a term of community\n\nservice not less than forty (40) nor more than eighty (80) hours.\n\nThe court in which any such conviction is had shall notify the\n\ncounty superintendent of public health of such conviction.\n\nB. Any person who engages in an act of prostitution with\n\nknowledge that he or she is infected with the human immunodeficiency\n\nvirus shall, upon conviction, be guilty of a felony punishable by\n\nimprisonment in the custody of the Department of Corrections for not\n\nmore than five (5) years.\n\nC. Any person who engages in an act of child sex trafficking as\n\ndefined in Section 1030 of this title shall, upon conviction, be\n\nguilty of a felony punishable by imprisonment in the custody of the\n\nDepartment of Corrections for not more than ten (10) years and by\n\nfines as follows: a fine not more than Five Thousand Dollars\n\n($5,000.00) upon the first conviction, a fine not more than Ten\n\nThousand Dollars ($10,000.00) upon the second conviction, and a fine\n\nnot more than Fifteen Thousand Dollars ($15,000.00) upon the third\n\nor subsequent convictions.\n\nD. Any person violating any of the provisions of Section 1028,\n\n1029 or 1030 of this title within one thousand (1,000) feet of a\n\nschool or church shall, upon conviction, be guilty of a felony and\n\nshall be punished by imprisonment in the custody of the Department\n\nof Corrections for not more than five (5) years or by fines as\n\nfollows: a fine not more than Two Thousand Five Hundred Dollars\n\n($2,500.00) upon the first conviction for violation of any of such\n\nprovisions, a fine not more than Five Thousand Dollars ($5,000.00)\n\nupon the second conviction for violation of any of such provisions,\n\nand a fine not more than Seven Thousand Five Hundred Dollars\n\n($7,500.00) upon the third or subsequent convictions for violation\n\nof any of such provisions, or by both such imprisonment and fine.\n\nIn addition, the court may require a term of community service not\n\nless than forty (40) nor more than eighty (80) hours.
