Stat. tit. 21, § 21-1031v2","heading":"Punishment for violations - Fines - Knowingly engaging","body":"in prostitution while infected with HIV - Violations within certain\n\ndistance from school or church.\n\nA. Except as provided in subsection B, C, D, or E of this\n\nsection, any person violating any of the provisions of paragraph 1,\n\n2, 3, or 5 of subsection A of Section 1029 or Section 1030 of this\n\ntitle shall, upon conviction, be guilty of a misdemeanor and shall\n\nbe punished by imprisonment in the county jail for not less than\n\nthirty (30) days nor more than one (1) year or by fines as follows:\n\na fine not more than Two Thousand Five Hundred Dollars ($2,500.00)\n\nupon the first conviction for violation of any of such provisions, a\n\nfine not more than Five Thousand Dollars ($5,000.00) upon the second\n\nconviction for violation of any of such provisions, and a fine not\n\nmore than Seven Thousand Five Hundred Dollars ($7,500.00) upon the\n\nthird or subsequent convictions for violation of any of such\n\nprovisions, or by both such imprisonment and fine. In addition, the\n\ncourt may require a term of community service not less than forty\n\n(40) nor more than eighty (80) hours. The court in which any such\n\nconviction is had shall notify the county superintendent of public\n\nhealth of such conviction.\n\nB. Any person who engages in an act of prostitution with\n\nknowledge that he or she is infected with the human immunodeficiency\n\nvirus shall, upon conviction, be guilty of a Class D1 felony offense\n\npunishable by imprisonment as provided for in subsections B through\n\nF of Section 20N of this title.\n\nC. Any person who engages in an act of child prostitution as\n\ndefined in Section 1030 of this title shall, upon conviction, be\n\nguilty of a Class B1 felony offense punishable by imprisonment in\n\nthe custody of the Department of Corrections for not more than ten\n\n(10) years and by fines as follows: a fine not more than Five\n\nThousand Dollars ($5,000.00) upon the first conviction, a fine not\n\nmore than Ten Thousand Dollars ($10,000.00) upon the second\n\nconviction, and a fine not more than Fifteen Thousand Dollars\n\n($15,000.00) upon the third or subsequent convictions.\n\nD. Any person violating any of the provisions of Section 1029\n\nor 1030 of this title within one thousand (1,000) feet of a school\n\nor church shall, upon conviction, be guilty of a Class D1 felony\n\noffense and shall be punished by imprisonment as provided for in\n\nsubsections B through F of Section 20N of this title, or by fines as\n\nfollows: a fine not more than Two Thousand Five Hundred Dollars\n\n($2,500.00) upon the first conviction for violation of any of such\n\nprovisions, a fine not more than Five Thousand Dollars ($5,000.00)\n\nupon the second conviction for violation of any of such provisions,\n\nand a fine not more than Seven Thousand Five Hundred Dollars\n\n($7,500.00) upon the third or subsequent convictions for violation\n\nof any of such provisions, or by both such imprisonment and fine.\n\nIn addition, the court may require a term of community service not\n\nless than forty (40) nor more than eighty (80) hours.
