Stat. tit. 21, § 21-1040.13a","heading":"Facilitating, encouraging, offering or soliciting","body":"sexual conduct or engaging in sexual communication with a minor or\n\nperson believed to be a minor.\n\nA. It is unlawful for any person to facilitate, encourage,\n\noffer or solicit sexual conduct with a minor, or other individual\n\nthe person believes to be a minor, by use of any technology, or to\n\nengage in any communication for sexual or prurient interest with any\n\nminor, or other individual the person believes to be a minor, by use\n\nof any technology. For purposes of this subsection, “by use of any\n\ntechnology” means the use of any telephone or cell phone, computer\n\ndisk (CD), digital video disk (DVD), recording or sound device, CD-\n\nROM, VHS, computer, computer network or system, Internet or World\n\nWide Web address including any blog site or personal web address, e-\n\nmail address, Internet Protocol address (IP), text messaging or\n\npaging device, any video, audio, photographic or camera device of\n\nany computer, computer network or system, cell phone, any other\n\nelectrical, electronic, computer or mechanical device, or any other\n\ndevice capable of any transmission of any written or text message,\n\naudio or sound message, photographic, video, movie, digital or\n\ncomputer-generated image, or any other communication of any kind by\n\nuse of an electronic device.\n\nB. A person is guilty of violating the provisions of this\n\nsection if the person knowingly transmits any prohibited\n\ncommunication by use of any technology defined herein, or knowingly\n\nprints, publishes or reproduces by use of any technology described\n\nherein any prohibited communication, or knowingly buys, sells,\n\nreceives, exchanges, or disseminates any prohibited communication or\n\nany information, notice, statement, website, or advertisement for\n\ncommunication with a minor or access to any name, telephone number,\n\ncell phone number, e-mail address, Internet address, text message\n\naddress, place of residence, physical characteristics or other\n\ndescriptive or identifying information of a minor, or other\n\nindividual the person believes to be a minor.\n\nC. The fact that an undercover operative or law enforcement\n\nofficer was involved in the detection and investigation of an\n\noffense pursuant to this section shall not constitute a defense to a\n\nprosecution under this section.\n\nD. Any violation of the provisions of this section shall be a\n\nClass B4 felony offense, punishable by a fine in an amount not to\n\nexceed Ten Thousand Dollars ($10,000.00), or by imprisonment in the\n\ncustody of the Department of Corrections for a term of not more than\n\nten (10) years, or by both such fine and imprisonment. For purposes\n\nof this section, each communication shall constitute a separate\n\noffense. Except for persons sentenced to life or life without\n\nparole, any person sentenced to imprisonment for two (2) years or\n\nmore for a violation of this section shall be required to serve a\n\nterm of post-imprisonment supervision pursuant to subparagraph f of\n\nparagraph 1 of subsection A of Section 991a of Title 22 of the\n\nOklahoma Statutes under conditions determined by the Department of\n\nCorrections. The jury shall be advised that the mandatory post-\n\nimprisonment supervision shall be in addition to the actual\n\nimprisonment.\n\nE. For purposes of any criminal prosecution pursuant to any\n\nviolation of this section, the person violating the provisions of\n\nthis section shall be deemed to be within the jurisdiction of this\n\nstate by the fact of accessing any computer, cellular phone or other\n\ncomputer-related or satellite-operated device in this state,\n\nregardless of the actual jurisdiction where the violator resides.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"11f1d6d4aefd1c9be8bb85ae5bf229079d3a1c39d70b2e80e05528d8ffbb45ec","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1040.13","next":"us-ok/okla.-stat.-tit.-21-21-1040.13b"},"notice":"GroundRules: Original legal text.
