Stat. tit. 21, § 21-1040.18","heading":"Trial - Evidence","body":"(a) The court shall conduct the trial in accordance with the\n\nrules of civil procedure applicable to the trial of cases by the\n\ncourt without a jury.\n\n(b) The court shall receive evidence at the trial, including the\n\ntestimony of experts, pertaining, but not limited, to:\n\n(1) whether, to the average person, applying contemporary\n\ncommunity standards, the dominant theme of the mailable matter taken\n\nas a whole is to prurient interest;\n\n(2) the artistic, literary, scientific and educational merits of\n\nthe mailable matter considered as a whole;\n\n(3) the intent of the author and publisher in preparing, writing\n\nand publishing the mailable matter;\n\n(4) the appeal to prurient interest, or absence thereof, in\n\nadvertising or other promotion of the mailable matter.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9a2c00ca0390d38019301d0f102786cb9875882dcda89b19a5e0a7b1040781f7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1040.17","next":"us-ok/okla.-stat.-tit.-21-21-1040.20"},"notice":"GroundRules: Original legal text.
