Stat. tit. 21, § 21-1040.76","heading":"Legislative findings — Legislative intent — Material","body":"or performances harmful to minors — Prohibited acts.\n\nThe Legislature finds that protecting minor children from\n\novertly sexual and violent content is a legitimate objective that\n\nshould be actively enforced.\n\nThe Legislature further finds that the protection of the right\n\nof the people to engage in the freedom of speech and expression is a\n\nsacred right in the United States; however, such performances and\n\nmaterials may not contain depictions of sexual conduct, nudity, or\n\ninappropriate violence which are harmful to minor children.\n\nTherefore, it is the intent of the Legislature that these\n\nprovisions be diligently enforced to protect minor children while\n\nalso protecting the free speech rights of the public.\n\nNo person, including but not limited to any persons having\n\ncustody, control or supervision of any commercial establishment,\n\nshall knowingly:\n\n1. Display material which is harmful to minors in such a way\n\nthat minors, as a part of the invited general public, will be\n\nexposed to view such material. Provided, however, a person shall be\n\ndeemed not to have \"displayed\" material harmful to minors if the\n\nmaterial is kept behind devices commonly known as \"blinder racks\" so\n\nthat the lower two-thirds (2/3) of the material is not exposed to\n\nview;\n\n2. Sell, furnish, present, distribute, allow to view, or\n\notherwise disseminate to a minor, with or without consideration, any\n\nmaterial which is harmful to minors; or\n\n3.
