A lottery is any scheme for the disposal or distribution of\n\nproperty by chance among persons who have paid, or promised, or\n\nagreed to pay any valuable consideration for the chance of obtaining\n\nsuch property, or a portion of it, or for any share of or interest\n\nin such property, upon any agreement, understanding or expectation\n\nthat it is to be distributed or disposed of by a lot or chance,\n\nwhether called a lottery, a raffle, or a gift enterprise, or by\n\nwhatever name the same may be known. \"Valuable consideration\" shall\n\nbe construed to mean money or goods of actual pecuniary value.\n\nProvided, it shall not be a violation of the lottery or gambling\n\nlaws of this state for:\n\n1. The Oklahoma Lottery Commission to conduct a lottery\n\npursuant to the provisions of the Oklahoma Education Lottery Act;\n\n2. A bona fide resident merchant or merchants of a city or\n\ntown, acting in conjunction with the Chamber of Commerce or\n\nCommercial Club of this state thereof, to issue free of charge\n\nnumbered tickets on sales of merchandise, the corresponding stub of\n\none or more of which tickets to be drawn or chosen by lot by a\n\nrepresentative or representatives of the Chamber of Commerce or of\n\nthe Commercial Club in the manner set forth on the tickets, the\n\nnumbered stub or stubs so drawn to entitle the holder of the\n\ncorresponding numbered issued ticket to a valuable prize donated by\n\nthe merchant;\n\n3. A bona fide community chest welfare fund on a military post\n\nor reservation to issue numbered tickets in conjunction with\n\nvoluntary contributions to the fund, the corresponding stub or stubs\n\nof one or more of the tickets to be drawn by lot under the\n\nsupervision of a military commander, the stub or stubs so drawn\n\nentitling the ticket holder to a prize of some value. Provided,\n\nhowever, that no person shall sell tickets or receive contributions\n\nto the fund off the military reservation;\n\n4. a. A qualified organization to raise funds by issuing\n\nnumbered tickets in conjunction with voluntary\n\ncontributions to the qualified organization, the\n\ncorresponding stub or stubs of one or more of the\n\ntickets to be drawn by lot under the supervision of an\n\nofficial of the qualified organization, the stub or\n\nstubs so drawn entitling the ticket holder to a prize.\n\nAs used in this paragraph, \"qualified organization\"\n\nmeans:\n\n(1) a church,\n\n(2) a public or private school accredited by the\n\nState Department of Education or registered by\n\nthe State Board of Education for purposes of\n\nparticipating in federal programs,\n\n(3) a student group or organization affiliated with a\n\npublic or private school qualified pursuant to\n\ndivision (2) of this subparagraph,\n\n(4) a parent-teacher association or organization\n\naffiliated with a public or private school\n\nqualified pursuant to division (2) of this\n\nsubparagraph,\n\n(5) fire departments,\n\n(6) police departments,\n\n(7) organizations that are exempt from taxation\n\npursuant to the provisions of subsection (c) of\n\nSection 501 of the United States Internal Revenue\n\nCode, as amended, 26 U.S.C., Section 501(c) et\n\nseq., or\nublic or private school\n\nqualified pursuant to division (2) of this\n\nsubparagraph,\n\n(5) fire departments,\n\n(6) police departments,\n\n(7) organizations that are exempt from taxation\n\npursuant to the provisions of subsection (c) of\n\nSection 501 of the United States Internal Revenue\n\nCode, as amended, 26 U.S.C., Section 501(c) et\n\nseq., or\n\n(8) an \"organization\" as such term is defined in\n\nparagraph 20 of Section 402 of Title 3A of the\n\nOklahoma Statutes.\n\nb. Any raffle conducted by a qualified organization shall\n\nbe conducted by members of the qualified organization\n\nwithout compensation to any member. The organization\n\nshall not hire or contract with any person or business\n\nassociation, corporation, partnership, limited\n\npartnership or limited liability company to conduct a\n\nraffle, to sell raffle tickets or to solicit\n\ncontributions in connection with a raffle on behalf of\n\nthe organization;\n\n5. The Oklahoma Department of Wildlife Conservation to conduct\n\ncontrolled, draw, lottery or raffle hunts; or\n\n6. Savings promotion raffle accounts or programs pursuant to\n\nSection 1 of this act.\n\nB. If the Oklahoma Education Lottery Act ceases to have the\n\nforce and effect of law pursuant to Section 735 of Title 3A of the\n\nOklahoma Statutes, the provisions of paragraph 3 of subsection A of\n\nthis section shall cease to have the force and effect of law.\n\nR.L. 1910, § 2470.
