Stat. tit. 21, § 21-1115v2","heading":"Punishment for rape in first degree","body":"\n\nRape in the first degree is a Class A2 felony offense punishable\n\nby death or imprisonment in the custody of the Department of\n\nCorrections, for a term of not less than five (5) years, life or\n\nlife without parole. Except for persons sentenced to life or life\n\nwithout parole, any person sentenced to imprisonment for two (2)\n\nyears or more for a violation of this section shall be required to\n\nserve a term of post-imprisonment supervision pursuant to\n\nsubparagraph f of paragraph 1 of subsection A of Section 991a of\n\nTitle 22 of the Oklahoma Statutes under conditions determined by the\n\nDepartment of Corrections. The jury shall be advised that the\n\nmandatory post-imprisonment supervision shall be in addition to the\n\nactual imprisonment. Any person convicted of a second or subsequent\n\nviolation of subsection A of Section 1114 of this title shall not be\n\neligible for any form of probation. Any person convicted of a third\n\nor subsequent violation of subsection A of Section 1114 of this\n\ntitle or of an offense under Section 888 of this title or an offense\n\nunder Section 1123 of this title or sexual abuse of a child pursuant\n\nto Section 843.5 of this title, or any attempt to commit any of\n\nthese offenses or any combination of these offenses shall be\n\npunished by imprisonment in the custody of the Department of\n\nCorrections for life or life without parole.\n\nR.L. 1910, § 2418.
