Stat. tit. 21, § 21-1125","heading":"Zone of safety - Schools, child care centers,","body":"playgrounds, parks and residences of victims - Restrictions on\n\nconvicted sex offenders - Exemptions.\n\nA. A zone of safety is hereby created around elementary, junior\n\nhigh and high schools, permitted or licensed child care centers as\n\ndefined by the Department of Human Services, playgrounds, parks or\n\nthe residence of a victim of a sex crime.\n\n1. A person is prohibited from loitering within five hundred\n\n(500) feet of any elementary, junior high or high school, permitted\n\nor licensed child care center, playground, or park if the person has\n\nbeen convicted of a crime that requires the person to register\n\npursuant to the Sex Offenders Registration Act or the person has\n\nbeen convicted of an offense in another jurisdiction, which offense\n\nif committed or attempted in this state, would have been punishable\n\nas one or more of the offenses listed in Section 582 of Title 57 of\n\nthe Oklahoma Statutes and the victim was a child under the age of\n\nsixteen (16) years.\n\n2. A person is prohibited from entering any park if:\n\na. the person has been designated as a habitual or\n\naggravated sex offender as provided in Section 584 of\n\nTitle 57 of the Oklahoma Statutes, or\n\nb. the person has been convicted of an offense in another\n\njurisdiction, which offense, if committed or attempted\n\nin this state, would designate the person as a\n\nhabitual or aggravated sex offender as provided in\n\nSection 584 of Title 57 of the Oklahoma Statutes.\n\n3. A person is prohibited from loitering within one thousand\n\n(1,000) feet of the residence of his or her victim if:\n\na. the person who committed a sex crime against the\n\nvictim has been convicted of said crime, and\n\nb. the person is required to register pursuant to the Sex\n\nOffenders Registration Act.\n\nB. A person convicted of a violation of subsection A of this\n\nsection shall be guilty of a Class D1 felony offense punishable by a\n\nfine not exceeding Two Thousand Five Hundred Dollars ($2,500.00), or\n\nby imprisonment as provided for in subsections B through F of\n\nSection 20N of this title, or by both such fine and imprisonment.\n\nAny person convicted of a second or subsequent violation of\n\nsubsection A of this section shall be guilty of a Class D1 felony\n\noffense and shall be punished by a fine not exceeding Two Thousand\n\nFive Hundred Dollars ($2,500.00), or by imprisonment as provided for\n\nin subsections B through F of Section 20N of this title, or by both\n\nsuch fine and imprisonment. This proscription of conduct shall not\n\nmodify or remove any restrictions currently applicable to the person\n\nby court order, conditions of probation or as provided by other\n\nprovision of law.\n\nC. 1. A person shall be exempt from the prohibition of this\n\nsection regarding a school or a licensed or permitted child care\n\nfacility only under the following circumstances and limited to a\n\nreasonable amount of time to complete such tasks:\n\na. the person is the custodial parent or legal guardian\n\nof a child who is an enrolled student at the school or\n\nchild care facility, and\n\nb. the person is enrolling, delivering or retrieving such\n\nchild at the school or licensed or permitted child\n\ncare center during regular school or facility hours or\n\nfor school-sanctioned or licensed-or-permitted-child-\n\ncare-center-sanctioned extracurricular activities.\n\nPrior to entering the zone of safety for the purposes listed in\n\nthis paragraph, the person shall inform school or child care center\n\nadministrators of his or her status as a registered sex offender.\n\nThe person shall update monthly, or as often as required by the\n\nschool or center, information about the specific times the person\n\nwill be within the zone of safety as established by this section.\n\n2. This exception shall not be construed to modify or remove\n\nany restrictions applicable to the person by court order, conditions\n\nof probation, or as provided by other provision of law.\nex offender.\n\nThe person shall update monthly, or as often as required by the\n\nschool or center, information about the specific times the person\n\nwill be within the zone of safety as established by this section.\n\n2. This exception shall not be construed to modify or remove\n\nany restrictions applicable to the person by court order, conditions\n\nof probation, or as provided by other provision of law.\n\nD. The provisions of subsection A of this section shall not\n\napply to any person receiving medical treatment at a hospital or\n\nother facility certified or licensed by the State of Oklahoma to\n\nprovide medical services. As used in this subsection, \"medical\n\ntreatment\" shall not include any form of psychological, social or\n\nrehabilitative counseling services or treatment programs for sex\n\noffenders.\n\nE. Nothing in this section shall prohibit a person, who is\n\nregistered as a sex offender pursuant to the Sex Offenders\n\nRegistration Act, from attending a recognized church or religious\n\ndenomination for worship; provided, the person has notified the\n\nreligious leader of his or her status as a registered sex offender\n\nand the person has been granted written permission by the religious\n\nleader.\n\nF. For purpose of prosecution of any violation of this section,\n\nthe provisions of Section 51.1 of this title shall not apply.\n\nG.
