Consent cannot\n\nbe:\n\n1. Given by an individual who:\n\na. is asleep or is mentally or physically incapacitated\n\neither through the effect of drugs or alcohol or for\n\nany other reason, or\n\nb. is under duress, threat, coercion or force; or\n\n2.
