Stat. tit. 21, § 21-1151a","heading":"Forfeiture of right to dispose of body of decedent","body":"Any person entitled by law to the right to dispose of the body\n\nof the decedent shall forfeit that right, and the right shall be\n\npassed on to the next qualifying person as listed in Section 1158 of\n\nTitle 21 of the Oklahoma Statutes, in the following circumstances:\n\n1. Any person charged with first or second degree murder or\n\nvoluntary manslaughter in connection with the death of the decedent,\n\nand whose charges are known to the funeral director; provided,\n\nhowever that if the charges against such person are dropped, or if\n\nsuch person is acquitted of the charges, the right of disposition\n\nshall be returned to the person;\n\n2. Any person who does not exercise the right of disposition\n\nwithin three (3) days of notification of the death of the decedent\n\nor within five (5) days of the death of the decedent, whichever is\n\nearlier; or\n\n3. If the district court, pursuant to Title 58 of the Oklahoma\n\nStatutes, determines that the person entitled to the right of\n\ndisposition and the decedent were estranged at the time of death.\n\nFor purposes of this paragraph, “estranged” means a physical and\n\nemotional separation from the decedent at the time of death that\n\nclearly demonstrates an absence of due affection, trust and regard\n\nfor the decedent.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b0b5f419e7678c0a32cff644985ffd921fac529f9f117029b69b82a952eeff96","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1151","next":"us-ok/okla.-stat.-tit.-21-21-1152"},"notice":"GroundRules: Original legal text.
