Stat. tit. 21, § 21-1172","heading":"Obscene, threatening or harassing telecommunication or","body":"other electronic communications - Penalty.\n\nA. It shall be unlawful for a person who, by means of a\n\ntelecommunication or other electronic communication device,\n\nwillfully either:\n\n1. Makes any comment, request, suggestion, or proposal which is\n\nobscene, lewd, lascivious, filthy, or indecent;\n\n2. Makes a telecommunication or other electronic communication\n\nincluding text, sound or images with intent to terrify, intimidate\n\nor harass, or threaten to inflict injury or physical harm to any\n\nperson or property of that person;\n\n3. Makes a telecommunication or other electronic communication,\n\nwhether or not conversation ensues, with intent to put the party\n\ncalled in fear of physical harm or death;\n\n4. Makes a telecommunication or other electronic communication,\n\nincluding text, sound or images whether or not conversation ensues,\n\nwithout disclosing the identity of the person making the call or\n\ncommunication and with intent to annoy, abuse, threaten, or harass\n\nany person at the called number;\n\n5. Knowingly permits any telecommunication or other electronic\n\ncommunication under the control of the person to be used for any\n\npurpose prohibited by this section; and\n\n6. In conspiracy or concerted action with other persons, makes\n\nrepeated calls or electronic communications or simultaneous calls or\n\nelectronic communications solely to harass any person at the called\n\nnumber(s).\n\nB. As used in this section, \"telecommunication\" and \"electronic\n\ncommunication\" mean any type of telephonic, electronic or radio\n\ncommunications, or transmission of signs, signals, data, writings,\n\nimages and sounds or intelligence of any nature by telephone,\n\nincluding cellular telephones, wire, cable, radio, electromagnetic,\n\nphotoelectronic or photo-optical system or the creation, display,\n\nmanagement, storage, processing, transmission or distribution of\n\nimages, text, voice, video or data by wire, cable or wireless means,\n\nincluding the Internet. The term includes:\n\n1. A communication initiated by electronic mail, instant\n\nmessage, network call, or facsimile machine including text, sound or\n\nimages;\n\n2. A communication made to a pager; or\n\n3. A communication including text, sound or images posted to a\n\nsocial media or other public media source.\n\nC. Use of a telephone or other electronic communications\n\nfacility under this section shall include all use made of such a\n\nfacility between the points of origin and reception. Any offense\n\nunder this section is a continuing offense and shall be deemed to\n\nhave been committed at either the place of origin or the place of\n\nreception.\n\nD. Except as provided in subsection E of this section, any\n\nperson who is convicted of the provisions of subsection A of this\n\nsection, shall be guilty of a misdemeanor.\n\nE.
