No student organization or any person associated with any\n\norganization sanctioned or authorized by the governing board of any\n\npublic or private school or institution of higher education in this\n\nstate shall engage or participate in hazing.\n\nB. Any hazing activity described in subsection F of this\n\nsection upon which the initiation or admission into or affiliation\n\nwith an organization sanctioned or authorized by a public or private\n\nschool or by any institution of higher education in this state is\n\ndirectly or indirectly conditioned shall be presumed to be a forced\n\nactivity, even if the student willingly participates in such\n\nactivity.\n\nC. A copy of the policy or the rules and regulations of the\n\npublic or private school or institution of higher education which\n\nprohibits hazing shall be given to each student enrolled in the\n\nschool or institution and shall be deemed to be part of the bylaws\n\nof all organizations operating at the public school or the\n\ninstitution of higher education.\n\nD. Any organization sanctioned or authorized by the governing\n\nboard of a public or private school or of an institution of higher\n\neducation in this state which violates subsection A of this section,\n\nupon conviction, shall be guilty of a misdemeanor, and may be\n\npunishable by a fine of not more than One Thousand Five Hundred\n\nDollars ($1,500.00) and the forfeit for a period of not less than\n\none (1) year all of the rights and privileges of being an\n\norganization organized or operating at the public or private school\n\nor at the institution of higher education.\n\nE. Any individual convicted of violating the provisions of\n\nsubsection A of this section shall be guilty of a misdemeanor, and\n\nmay be punishable by imprisonment for not to exceed ninety (90) days\n\nin the county jail, or by the imposition of a fine not to exceed\n\nFive Hundred Dollars ($500.00), or by both such imprisonment and\n\nfine.\n\nF. For purposes of this section:\n\n1. \"Hazing\" means an activity which recklessly or intentionally\n\nendangers the mental health or physical health or safety of a\n\nstudent for the purpose of initiation or admission into or\n\naffiliation with any organization operating subject to the sanction\n\nof the public or private school or of any institution of higher\n\neducation in this state;\n\n2. \"Endanger the physical health\" shall include but not be\n\nlimited to any brutality of a physical nature, such as whipping,\n\nbeating, branding, forced calisthenics, exposure to the elements,\n\nforced consumption of any food, alcoholic beverage as defined in\n\nSection 506 of Title 37 of the Oklahoma Statutes, low-point beer as\n\ndefined in Section 163.2 of Title 37 of the Oklahoma Statutes, drug,\n\ncontrolled dangerous substance, or other substance, or any other\n\nforced physical activity which could adversely affect the physical\n\nhealth or safety of the individual; and\n\n3. \"Endanger the mental health\" shall include any activity,\n\nexcept those activities authorized by law, which would subject the\n\nindividual to extreme mental stress, such as prolonged sleep\n\ndeprivation, forced prolonged exclusion from social contact, forced\n\nconduct which could result in extreme embarrassment, or any other\n\nforced activity which could adversely affect the mental health or\n\ndignity of the individual.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"084d34876568397f79f2062e2b8ca3d902be1fffd1faa09b4a25ca540d3a0374","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1176","next":"us-ok/okla.-stat.-tit.-21-21-1191"},"notice":"GroundRules: Original legal text.
