As used in the Environmental Crimes Act:\n\n1. \"Waste\" means at least twenty-eight (28) gallons or two\n\nhundred twenty (220) pounds, whether liquid or solid, of discarded\n\nor abandoned materials and by-products including but not limited to\n\ntrash, refuse, garbage, biomedical waste, sewage, ash, sludge,\n\ndeleterious substances, oil field wastes, commercial and industrial\n\nwaste and chemical waste; and\n\n2. \"Hazardous waste\" means:\n\na. waste that is subject to regulation as a hazardous\n\nwaste under the federal Resource Conservation and\n\nRecovery Act, Title 42 U.S.C., Section 6901 et seq.,\n\nand regulations adopted pursuant thereto,\n\nb. waste that is subject to regulation as a hazardous\n\nwaste under the Oklahoma Hazardous Waste Management\n\nAct, or\n\nc. waste that is ignitable, corrosive, reactive or toxic\n\nas determined by testing for the characteristics of\n\nignitability, corrosivity, reactivity or toxicity as\n\nprovided in 40 Code of Federal Regulations, Sections\n\n261.21 through 261.24.\n\nB. The minimum quantity requirements in paragraph 1 of\n\nsubsection A of this section shall not apply to chemical wastes used\n\nor intended for use in the manufacture of controlled substances in\n\nviolation of the Uniform Controlled Dangerous Substances Act and\n\nshall not apply to hazardous wastes in circumstances involving\n\nunlawful disposal or concealment of hazardous waste as prohibited in\n\nSections 1230.6 and 1230.7 of this title.\n\nC.
