Every person who, without justifiable or excusable cause,\n\nwillfully commits biochemical assault against another person shall\n\nbe punished as provided in this section.\n\nB. Every act of biochemical assault is a misdemeanor punishable\n\nby imprisonment in the county jail for a term of not more than one\n\n(1) year, or by a fine not to exceed One Thousand Dollars\n\n($1,000.00), or by both such fine and imprisonment when the person\n\nknows the substance or material used to commit biochemical assault\n\nis not toxic, noxious, or lethal to humans. In addition to any term\n\nof imprisonment imposed for biochemical assault, the person shall be\n\nordered to make restitution to the victim and to reimburse the cost\n\nof any emergency personnel, equipment, supplies, and other expenses\n\nincurred by the state and any political subdivision as a result of\n\nresponding to such act.\n\nC. Every act of biochemical assault is a Class B1 felony\n\noffense punishable by imprisonment in the State Penitentiary for a\n\nterm of not more than ten (10) years when the person knows the\n\nsubstance or material used to commit biochemical assault is toxic,\n\nnoxious, or lethal to humans.
