Stat. tit. 21, § 21-1280.1","heading":"Possession of firearm on school property","body":"POSSESSION OF FIREARM ON SCHOOL PROPERTY\n\nA. It shall be unlawful for any person to have in his or her\n\npossession on any public or private school property or while in any\n\nschool bus or vehicle used by any school for transportation of\n\nstudents or teachers any firearm or weapon designated in Section\n\n1272 of this title, except as provided in subsection C of this\n\nsection or as otherwise authorized by law.\n\nB. For purposes of this section:\n\n1. \"School property\" means any publicly owned property held for\n\npurposes of elementary, secondary or vocational-technical education,\n\nand shall not include property owned by public school districts or\n\nwhere such property is leased or rented to an individual or\n\ncorporation and used for purposes other than educational;\n\n2. \"Private school\" means a school that offers a course of\n\ninstruction for students in one or more grades from prekindergarten\n\nthrough grade twelve and is not operated by a governmental entity;\n\nand\n\n3. \"Motor vehicle\" means any automobile, truck, minivan or\n\nsports utility vehicle.\n\nC. Firearms and weapons are allowed on school property and\n\ndeemed not in violation of subsection A of this section as follows:\n\n1. A gun or knife designed for hunting or fishing purposes kept\n\nin a privately owned vehicle and properly displayed or stored as\n\nrequired by law, provided such vehicle containing said gun or knife\n\nis driven onto school property only to transport a student to and\n\nfrom school and such vehicle does not remain unattended on school\n\nproperty;\n\n2. A gun or knife used for the purposes of participating in the\n\nOklahoma Department of Wildlife Conservation certified hunter\n\ntraining education course or any other hunting, fishing, safety or\n\nfirearms training courses, or a recognized firearms sports event,\n\nteam shooting program or competition, or living history reenactment,\n\nprovided the course or event is approved by the principal or chief\n\nadministrator of the school where the course or event is offered,\n\nand provided the weapon is properly displayed or stored as required\n\nby law pending participation in the course, event, program or\n\ncompetition;\n\n3. Weapons in the possession of any peace officer or other\n\nperson authorized by law to possess a weapon in the performance of\n\nhis or her duties and responsibilities;\n\n4. A concealed or unconcealed weapon carried onto private\n\nschool property or in any school bus or vehicle used by any private\n\nschool for transportation of students or teachers by a person who is\n\nlicensed pursuant to the Oklahoma Self-Defense Act, provided a\n\npolicy has been adopted by the governing entity of the private\n\nschool that authorizes the possession of a weapon on private school\n\nproperty or in any school bus or vehicle used by a private school.\n\nExcept for acts of gross negligence or willful or wanton misconduct,\n\na governing entity of a private school that adopts a policy which\n\nauthorizes the possession of a weapon on private school property, a\n\nschool bus or vehicle used by the private school shall be immune\n\nfrom liability for any injuries arising from the adoption of the\n\npolicy. The provisions of this paragraph shall not apply to claims\n\npursuant to the Workers' Compensation Code;\n\n5. A gun, knife, bayonet or other weapon in the possession of a\n\nmember of a veterans group, the national guard, active military, the\n\nReserve Officers' Training Corps (ROTC) or Junior ROTC, in order to\n\nparticipate in a ceremony, assembly or educational program approved\n\nby the principal or chief administrator of a school or school\n\ndistrict where the ceremony, assembly or educational program is\n\nbeing held; provided, however, the gun or other weapon that uses\n\nprojectiles is not loaded and is inoperable at all times while on\n\nschool property;\n\n6. A handgun carried in a motor vehicle pursuant to a valid\n\nhandgun license authorized by the Oklahoma Self-Defense Act onto\nhe principal or chief administrator of a school or school\n\ndistrict where the ceremony, assembly or educational program is\n\nbeing held; provided, however, the gun or other weapon that uses\n\nprojectiles is not loaded and is inoperable at all times while on\n\nschool property;\n\n6. A handgun carried in a motor vehicle pursuant to a valid\n\nhandgun license authorized by the Oklahoma Self-Defense Act onto\n\nproperty set aside by a public or private elementary or secondary\n\nschool for the use or parking of any vehicle; provided, however,\n\nsaid handgun shall be stored and hidden from view in a locked motor\n\nvehicle when the motor vehicle is left unattended on school\n\nproperty; and\n\n7. A handgun carried onto public school property by school\n\npersonnel who have been designated by the board of education,\n\nprovided such personnel either:\n\na. possess a valid armed security guard license as\n\nprovided for in Section 1750.1 et seq. of Title 59 of\n\nthe Oklahoma Statutes, or\n\nb. hold a valid reserve peace officer certification as\n\nprovided for in Section 3311 of Title 70 of the\n\nOklahoma Statutes,\n\nif a policy has been adopted by the board of education of the school\n\ndistrict that authorizes the carrying of a handgun onto public\n\nschool property by such personnel. Nothing in this subsection shall\n\nbe construed to restrict authority granted elsewhere in law to carry\n\nfirearms.\n\nD.
