Stat. tit. 21, § 21-1289.24","heading":"Firearm regulation - State preemption","body":"FIREARM REGULATION – STATE PREEMPTION\n\nA. 1. The State Legislature hereby occupies and preempts the\n\nentire field of legislation in this state touching in any way\n\nfirearms, air powered pistols, air powered rifles, knives,\n\ncomponents, ammunition and supplies to the complete exclusion of any\n\norder, ordinance or regulation by any municipality or other\n\npolitical subdivision of this state. Any existing or future orders,\n\nordinances or regulations in this field, except as provided for in\n\nparagraph 2 of this subsection and subsection C of this section, are\n\nnull and void.\n\n2. A municipality may adopt any ordinance:\n\na. relating to the discharge of firearms within the\n\njurisdiction of the municipality,\n\nb. allowing the municipality to issue a traffic citation\n\nfor transporting a firearm improperly as provided for\n\nin Section 1289.13A of this title, provided, however,\n\nthat penalties contained for violation of any\n\nordinance enacted pursuant to the provisions of this\n\nsubparagraph shall not exceed the penalties\n\nestablished in the Oklahoma Self-Defense Act, and\n\nc. allowing the municipality to issue a citation to an\n\nindividual or the parent or guardian of a minor who\n\ndischarges an air powered pistol or air powered rifle\n\nin an intentional or negligent manner which causes the\n\nprojectile to leave the intended premises.\n\n3. As provided in the preemption provisions of this section,\n\nthe otherwise lawful carrying or possession of a firearm under the\n\nprovisions of Chapter 53 of this title shall not be punishable by\n\nany municipality or other political subdivision of this state as\n\ndisorderly conduct, disturbing the peace or similar offense against\n\npublic order.\n\n4. A public or private school may create a policy regulating\n\nthe possession of knives on school property or in any school bus or\n\nvehicle used by the school for purposes of transportation.\n\nB. No municipality or other political subdivision of this state\n\nshall adopt any order, ordinance or regulation concerning in any way\n\nthe sale, purchase, purchase delay, transfer, ownership, use,\n\nkeeping, possession, carrying, bearing, transportation, licensing,\n\npermit, registration, taxation other than sales and compensating use\n\ntaxes or other controls on firearms, knives, components, ammunition\n\nand supplies.\n\nC. Except as hereinafter provided, this section shall not\n\nprohibit any order, ordinance or regulation by any municipality\n\nconcerning the confiscation of property used in violation of the\n\nordinances of the municipality as provided for in Section 28-121 of\n\nTitle 11 of the Oklahoma Statutes. Provided, however, no municipal\n\nordinance relating to transporting a firearm or knife improperly may\n\ninclude a provision for confiscation of property.\n\nD. When a person's rights pursuant to the protection of the\n\npreemption provisions of this section have been violated, the person\n\nshall have the right to bring a civil action against the persons,\n\nmunicipality, and political subdivision jointly and severally for\n\ninjunctive relief or monetary damages or both.\n\nE.
