The State Legislature hereby occupies and preempts the\n\nentire field of legislation by any agency of this state or any\n\npolitical subdivision in this state to infringe upon the rights of a\n\ncitizen of the State of Oklahoma, the unalienable right to keep and\n\nbear arms as guaranteed to them by the Second Amendment of the\n\nUnited States Constitution.\n\nB. Any federal, state, county or municipal act, law, executive\n\norder, administrative order, court order, rule, policy or regulation\n\nordering the buy-back, confiscation or surrender of firearms,\n\nfirearm accessories or ammunition from law-abiding citizens of this\n\nstate shall be considered an infringement on the rights of citizens\n\nto keep and bear arms as guaranteed by the Second Amendment of the\n\nConstitution of the United States and Article II, Section 26 of the\n\nConstitution of Oklahoma.\n\nC. It shall be the duty of the courts and law enforcement\n\nagencies of this state to protect the rights of law-abiding citizens\n\nto keep and to bear arms within the borders of this state and to\n\nprotect these rights from the infringement provided under the\n\nprovisions of this act.\n\nD. The preemption provided in this act shall include:\n\n1. Any regulation of arms and ammunition, pursuant to the\n\nNational Firearms Act of 1934, prohibited or regulated on or after\n\nthe effective date of this act; and\n\n2. Any regulations or provision of the Gun Control Act of 1968,\n\nprohibited or regulated on or after the effective date of this act.\n\nE. For purposes of this section:\n\n1. \"Arms\" is defined as any firearm, firearm part, accessory or\n\nammunition required to render that firearm operable and effective;\n\n2. \"Infringement\" shall mean any law that reduces, represses,\n\ndiminishes or subverts the right to keep and bear arms, ammunition,\n\nparts and accessories in any amount that is legal as of the\n\neffective date of this act of any citizen in this state; and\n\n3. \"Law-abiding citizen\" means a person who is not otherwise\n\nprecluded under state law from possessing a firearm and shall not be\n\nconstrued to include anyone who is not legally present in the United\n\nStates or this state.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9e066f0ca6503bbd292a977752c7704158763544330a1e5a75cb44232940857c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1289.24d","next":"us-ok/okla.-stat.-tit.-21-21-1289.25"},"notice":"GroundRules: Original legal text.
