For purposes of this section:\n\n1. “Licensed dealer” means a person who is licensed pursuant to\n\n18 U.S.C., Section 923 and pursuant to any laws of this state and\n\nengages in the business of dealing in firearms;\n\n2. “Private seller” means a person who sells or offers for sale\n\nany firearm, as defined by the laws of this state, or ammunition;\n\n3. “Ammunition” means any cartridge, shell, or projectile\n\ndesigned for use in a firearm; and\n\n4. “Materially false information” means information that\n\nportrays an illegal transaction as legal or a legal transaction as\n\nillegal.\n\nB. Any person, who knowingly solicits, persuades, encourages or\n\nentices a licensed dealer or private seller of firearms or\n\nammunition to transfer a firearm or ammunition under circumstances\n\nwhich the person knows would violate the laws of this state or the\n\nUnited States is guilty of a felony.\n\nC. Any person who provides to a licensed dealer or private\n\nseller of firearms or ammunition what the person knows to be\n\nmaterially false information with intent to deceive the dealer or\n\nseller about the legality of a transfer of a firearm or ammunition\n\nis guilty of a felony.\n\nD. Any person who willfully procures another to engage in\n\nconduct prohibited by this section shall be held accountable as a\n\nprincipal.\n\nE. This section does not apply to a law enforcement officer\n\nacting in his or her official capacity or to a person acting at the\n\ndirection of such law enforcement officer.\n\nF.
