Stat. tit. 21, § 21-1289.30","heading":"Requests for certification for the transfer or making","body":"of a firearm – Court review of certification decisions.\n\nA. When certification by a chief law enforcement officer is\n\nrequired by federal law or regulation for the transfer or making of\n\na firearm, the chief law enforcement officer shall, within fifteen\n\n(15) days of receipt of a request for certification, provide such\n\ncertification if the applicant is not prohibited by law from\n\nreceiving the firearm or the applicant is not the subject of a\n\nproceeding that could result in the applicant being prohibited by\n\nlaw from receiving the firearm. If the applicant is prohibited by\n\nlaw from receiving the firearm or the applicant is the subject of a\n\nproceeding that could result in such prohibition, the chief law\n\nenforcement officer shall provide written notification to the\n\napplicant that certification has been denied and state the reasons\n\nfor such findings.\n\nB. An applicant whose request for certification is denied may\n\nappeal the decision of the chief law enforcement officer to the\n\ndistrict court that is located in the county in which the applicant\n\nresides. The court shall review the decision of the chief law\n\nenforcement officer to deny the certification de novo. If the court\n\nfinds that the applicant is not prohibited by law from receiving the\n\nfirearm or the applicant is not the subject of a proceeding that\n\ncould result in such prohibition, the court shall order the chief\n\nlaw enforcement officer to issue the certification and shall award\n\ncourt costs and reasonable attorney fees to the applicant.\n\nC. For purposes of this section:\n\n1. \"Certification\" means the participation and assent of the\n\nchief law enforcement officer necessary under federal law for the\n\napproval of the application to transfer or make a firearm;\n\n2. \"Chief law enforcement officer\" means any official that the\n\nBureau of Alcohol, Tobacco, Firearms and Explosives, or any\n\nsuccessor agency, identifies by regulation or otherwise as eligible\n\nto provide any required certification for applications to transfer\n\nor make a firearm; and\n\n3. \"Firearm\" shall have the same meaning as provided for in the\n\nNational Firearms Act, subsection a of Section 5845 of Title 26 of\n\nthe United States Code.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c0a28a5bebc2023f63cb75717b0d92750997480cab719b3fce1866472f981721","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1289.3","next":"us-ok/okla.-stat.-tit.-21-21-1289.31"},"notice":"GroundRules: Original legal text.
