Any fire marshal inspector who is retired, state, county or\n\nmunicipal peace officer of this state who is retired, or any state,\n\ncounty or municipal peace officer classified as a reserve who is\n\nretired, or any federal law enforcement officer who is retired may\n\nretain their status as a peace officer, retired, in the State of\n\nOklahoma, and as such may carry a firearm pursuant to the provisions\n\nof subsection B of this section. A retired state, county or\n\nmunicipal peace officer may in times of great emergency or danger\n\nserve to enforce the law, keep the peace or to protect the public in\n\nkeeping with their availability and ability at the request of the\n\nGovernor, the sheriff or the mayor of their retirement jurisdiction.\n\nIf a retired fire marshal is activated for duty, the peace officer\n\npowers of the retired fire marshal are limited to the duties granted\n\nprior to retirement.\n\nB. The Council on Law Enforcement Education and Training\n\n(CLEET) shall issue an identification card to eligible retired\n\nfederal, state, county, and municipal peace officers which\n\nauthorizes the retired peace officer to carry a firearm throughout\n\nthe State of Oklahoma. The identification card shall bear the full\n\nname of the retired officer, the signature of the retired officer,\n\nthe date of issuance, and such other information as may be deemed\n\nappropriate by CLEET. The card shall expire every ten (10) years\n\nand may be denied, suspended or revoked as provided by the rules\n\npromulgated by CLEET or upon the discovery of any preclusion\n\nprescribed in Section 1290.10 or 1290.11 of this title. In order to\n\nrenew the permit, the Council on Law Enforcement Education and\n\nTraining shall request, pursuant to Section 150.9 of Title 74 of the\n\nOklahoma Statutes, the Oklahoma State Bureau of Investigation to\n\nconduct a state and national criminal history records search on each\n\nretired peace officer authorized to carry a firearm pursuant to the\n\nprovisions of this section; and unless a preclusion prescribed in\n\nSection 1290.10 or 1290.11 of this title is found to exist, no\n\naction shall be necessary. A retired peace officer requesting a\n\nrenewal of his or her permit shall submit to the Council a\n\nnonrefundable fee for a national criminal history record with\n\nfingerprint analysis, as provided in Section 150.9 of Title 74 of\n\nthe Oklahoma Statutes. When a preclusion is discovered, the Council\n\nshall notify the retired peace officer and shall hold a hearing\n\nbefore taking any action to suspend or revoke the authority to carry\n\na firearm.\n\nC. The retired peace officer shall be required to submit the\n\nfollowing information to the Council on Law Enforcement Education\n\nand Training (CLEET) and any other information requested by CLEET:\n\n1. A statement from the appropriate law enforcement agency\n\nverifying the status of the person as a retired peace officer of\n\nthat jurisdiction; and\n\n2. A notarized statement, signed by the retired peace officer,\n\nstating that the officer:\n\na. has not been convicted of and is currently not subject\n\nto any pending criminal prosecution for any preclusion\n\nprescribed in Section 1290.10 or 1290.11 of this\n\ntitle,\n\nb. has not been forced into retirement due to any mental\n\ndisorder, and\n\nc. has not suffered any injury or any physical or mental\n\nimpairment which would render the person unsafe to\n\ncarry a firearm.\n\nD. A retired peace officer, who has made application for the\n\nCLEET identification card authorized in subsection B of this\n\nsection, shall be authorized to carry a firearm as an off-duty peace\n\nofficer, pursuant to Section 1289.23 of this title, until the\n\nauthority to carry a firearm as a retired officer is finally\n\napproved or denied by CLEET.\n\nE. The Council on Law Enforcement Education and Training shall\n\npromulgate rules and procedures necessary to implement the\n\nprovisions of this section.\nn subsection B of this\n\nsection, shall be authorized to carry a firearm as an off-duty peace\n\nofficer, pursuant to Section 1289.23 of this title, until the\n\nauthority to carry a firearm as a retired officer is finally\n\napproved or denied by CLEET.\n\nE. The Council on Law Enforcement Education and Training shall\n\npromulgate rules and procedures necessary to implement the\n\nprovisions of this section.\n\nF.
