The following conditions shall preclude a person from being\n\neligible for a handgun license pursuant to the provisions of the\n\nOklahoma Self-Defense Act for a period of time as prescribed in each\n\nof the following paragraphs:\n\n1. An arrest for an alleged commission of a felony offense or a\n\nfelony charge pending in this state, another state or pursuant to\n\nthe United States Code. The preclusive period shall be until the\n\nfinal determination of the matter;\n\n2. The person is subject to the provisions of a deferred\n\nsentence or deferred prosecution in this state or another state or\n\npursuant to federal authority for the commission of a felony\n\noffense. The preclusive period shall be three (3) years and shall\n\nbegin upon the final determination of the matter;\n\n3. Any involuntary commitment for a mental illness, condition,\n\nor disorder pursuant to the provisions of Section 5-410 of Title 43A\n\nof the Oklahoma Statutes or any involuntary commitment in another\n\nstate pursuant to any provisions of law of that state. The\n\npreclusive period shall be permanent as provided by Title 18 of the\n\nUnited States Code Section 922(g)(4) unless the person has been\n\ngranted relief from the disqualifying disability pursuant to Section\n\n1290.27 of this title;\n\n4. The person has previously undergone treatment for a mental\n\nillness, condition, or disorder which required medication or\n\nsupervision as defined by paragraph 7 of Section 1290.10 of this\n\ntitle. The preclusive period shall be three (3) years from the last\n\ndate of treatment or upon presentation of a certified statement from\n\na licensed physician stating that the person is either no longer\n\ndisabled by any mental or psychiatric illness, condition, or\n\ndisorder or that the person has been stabilized on medication for\n\nten (10) years or more;\n\n5. Inpatient treatment for substance abuse. The preclusive\n\nperiod shall be three (3) years from the last date of treatment or\n\nupon presentation of a certified statement from a licensed physician\n\nstating that the person has been free from substance use for twelve\n\n(12) months or more preceding the filing of an application for a\n\nhandgun license;\n\n6. Two or more convictions of public intoxication pursuant to\n\nsubsection D of Section 6-101 of Title 37A of the Oklahoma Statutes,\n\nor a similar law of another state. The preclusive period shall be\n\nthree (3) years from the date of the completion of the last sentence\n\nor shall require a certified statement from a licensed physician\n\nstating that the person is not in need of substance abuse treatment;\n\n7. Two or more misdemeanor convictions relating to intoxication\n\nor driving under the influence of an intoxicating substance or\n\nalcohol. The preclusive period shall be three (3) years from the\n\ndate of the completion of the last sentence or shall require a\n\ncertified statement from a licensed physician stating that the\n\nperson is not in need of substance abuse treatment;\n\n8. A court order for a final Victim Protection Order against\n\nthe applicant, as authorized by the Protection from Domestic Abuse\n\nAct, or any court order granting a final victim protection order\n\nagainst the applicant from another state. The preclusive period\n\nshall be sixty (60) days from the date an order was vacated,\n\ncanceled, withdrawn or is otherwise no longer in effect;\n\n9. An adjudicated delinquent or convicted felon residing in the\n\nresidence of the applicant which may be a violation of Section 1283\n\nof this title. The preclusive period shall be thirty (30) days from\n\nthe date the person no longer resides in the same residence as the\n\napplicant;\n\n10. An arrest for an alleged commission of, a charge pending\n\nfor, or the person is subject to the provisions of a deferred\n\nprosecution for any one or more of the following misdemeanor\n\noffenses in this state or another state:\n\na. any assault and battery which caused serious physical\nod shall be thirty (30) days from\n\nthe date the person no longer resides in the same residence as the\n\napplicant;\n\n10. An arrest for an alleged commission of, a charge pending\n\nfor, or the person is subject to the provisions of a deferred\n\nprosecution for any one or more of the following misdemeanor\n\noffenses in this state or another state:\n\na. any assault and battery which caused serious physical\n\ninjury to the victim or any second or subsequent\n\nassault and battery,\n\nb. any aggravated assault and battery,\n\nc. any stalking pursuant to Section 1173 of this title,\n\nor a similar law of another state,\n\nd. any violation of the Protection from Domestic Abuse\n\nAct or any violation of a victim protection order of\n\nanother state,\n\ne. any violation relating to illegal drug use or\n\npossession, or\n\nf. an act of domestic abuse as defined by Section 644 of\n\nthis title or an act of domestic assault and battery\n\nor any comparable acts under the law of another state.\n\nThe preclusive period shall be until the final determination of the\n\nmatter. The preclusive period for a person subject to the\n\nprovisions of a deferred sentence for the offenses mentioned in this\n\nparagraph shall be three (3) years and shall begin upon the final\n\ndetermination of the matter; or\n\n11. A previously issued handgun license has been revoked. The\n\npreclusive period shall be five (5) years from the date of\n\nrevocation and shall require the person to submit a new application\n\nfor a handgun license pursuant to the provisions of Section 1290.12\n\nof this title.\n\nB.
