Stat. tit. 21, § 21-1290.14","heading":"Safety and training course","body":"SAFETY AND TRAINING COURSE\n\nA. Each applicant for a license to carry a concealed or\n\nunconcealed handgun pursuant to the Oklahoma Self-Defense Act must\n\nsuccessfully complete a firearms safety and training course in this\n\nstate conducted by a registered and approved firearms instructor as\n\nprovided by the provisions of this section or from an interactive\n\nonline firearms safety and training course available electronically\n\nvia the Internet approved and certified by the Council on Law\n\nEnforcement Education and Training. The applicant must further\n\ndemonstrate competence and qualification with an authorized pistol\n\nto carry as a concealed or unconcealed handgun pursuant to the\n\nprovisions of the Oklahoma Self-Defense Act, except certain persons\n\nmay be exempt from such training requirement as provided by the\n\nprovisions of Section 1290.15 of this title.\n\nB. The Council on Law Enforcement Education and Training\n\n(CLEET) shall establish criteria for approving firearms instructors\n\nand interactive online firearms safety and training courses\n\navailable electronically via the Internet for purposes of training\n\nand qualifying individuals for a handgun license pursuant to the\n\nprovisions of the Oklahoma Self-Defense Act. Prior to submitting an\n\napplication for CLEET approval as a firearms instructor, applicants\n\nshall attend a firearms instructor school, meeting the following\n\nminimum requirements:\n\n1. Firearms instructor training conducted by one of the\n\nfollowing entities:\n\na. Council on Law Enforcement Education and Training,\n\nb. National Rifle Association,\n\nc. Oklahoma Rifle Association,\n\nd. federal law enforcement agencies, or\n\ne. other professionally recognized organizations;\n\n2. The course shall be at least sixteen (16) hours in length;\n\n3. Upon completion of the course, the applicant shall be\n\nqualified to provide instruction on pistols; and\n\n4. Receive a course completion certificate.\n\nAll firearms instructors shall be required to meet the\n\neligibility requirements for a handgun license as provided in\n\nSections 1290.9, 1290.10, and 1290.11 of this title and the\n\napplication shall be processed as provided for applicants in Section\n\n1290.12 of this title, including the state and national criminal\n\nhistory records search and fingerprint search. A firearms\n\ninstructor shall be required to pay a fee of One Hundred Dollars\n\n($100.00) to the Council on Law Enforcement Education and Training\n\n(CLEET) each time the person makes application for CLEET approval as\n\na firearms instructor pursuant to the provisions of the Oklahoma\n\nSelf-Defense Act. The fee shall be retained by CLEET and shall be\n\ndeposited into the Firearms Instructors Revolving Fund. CLEET shall\n\npromulgate the rules, forms and procedures necessary to implement\n\nthe approval of firearms instructors as authorized by the provisions\n\nof this subsection. CLEET shall periodically review each approved\n\ninstructor during a training and qualification course to assure\n\ncompliance with the rules and course contents. Any violation of the\n\nrules may result in the revocation or suspension of CLEET and\n\nOklahoma State Bureau of Investigation approval. Unless the\n\napproval has been revoked or suspended, a firearms instructor’s\n\nCLEET approval shall be for a term of five (5) years. CLEET shall\n\nbe responsible for notifying all approved firearms instructors of\n\nstatutory and policy changes related to the Oklahoma Self-Defense\n\nAct. A firearms instructor shall not be required to submit his or\n\nher fingerprints for a fingerprint search when renewing a firearms\n\ninstructor’s CLEET approval.\n\nC. 1. All firearms instructors approved by CLEET to train and\n\nqualify individuals for a handgun license shall be required to apply\n\nfor registration with the Oklahoma State Bureau of Investigation\n\nafter receiving CLEET approval. All firearms instructors teaching\n\nthe approved course for a handgun license must display their\ningerprint search when renewing a firearms\n\ninstructor’s CLEET approval.\n\nC. 1. All firearms instructors approved by CLEET to train and\n\nqualify individuals for a handgun license shall be required to apply\n\nfor registration with the Oklahoma State Bureau of Investigation\n\nafter receiving CLEET approval. All firearms instructors teaching\n\nthe approved course for a handgun license must display their\n\nregistration certificate during each training and qualification\n\ncourse. Each approved firearms instructor shall complete a\n\nregistration form provided by the Bureau and shall have the option\n\nto pay a registration fee of either One Hundred Dollars ($100.00)\n\nfor a five-year registration certificate or Two Hundred Dollars\n\n($200.00) for a ten-year registration certificate to the Bureau at\n\nthe time of each application for registration, except as provided in\n\nparagraph 2 of this subsection. Registration certificates issued by\n\nthe Bureau shall be valid for a period of five (5) years or ten (10)\n\nyears from the date of issuance. The Bureau shall issue a five-year\n\nor ten-year handgun license to an approved firearms instructor at\n\nthe time of issuance of a registration certificate and no additional\n\nfee shall be required or charged. The Bureau shall maintain a\n\ncurrent listing of all registered firearms instructors in this\n\nstate. Nothing in this paragraph shall be construed to eliminate\n\nthe requirement for registration and training with CLEET as provided\n\nin subsection B of this section. Failure to register or be trained\n\nas required shall result in a revocation or suspension of the\n\ninstructor certificate by the Bureau.\n\n2. Registered instructors listed in subparagraphs a and b of\n\nthis paragraph shall not be required to renew the firearms\n\ninstructor registration certificate with the Oklahoma State Bureau\n\nof Investigation at the expiration of the registration term,\n\nprovided the instructor is not subject to any suspension or\n\nrevocation of the firearms instructor certificate. The firearms\n\ninstructor registration with the Oklahoma State Bureau of\n\nInvestigation shall automatically renew together with the handgun\n\nlicense authorized in paragraph 1 of this subsection for an\n\nadditional five-year term and no additional cost or fee may be\n\ncharged for the following individuals:\n\na. an active duty law enforcement officer of this state\n\nor any of its political subdivisions or of the federal\n\ngovernment who has a valid CLEET approval as a\n\nfirearms instructor pursuant to the Oklahoma Self-\n\nDefense Act, and\n\nb. a retired law enforcement officer authorized to carry\n\na firearm pursuant to Section 1289.8 of this title who\n\nhas a valid CLEET approval as a firearms instructor\n\npursuant to the Oklahoma Self-Defense Act.\n\nD. The Oklahoma State Bureau of Investigation shall approve\n\nregistration for a firearms instructor applicant who is in full\n\ncompliance with CLEET rules regarding firearms instructors and the\n\nprovisions of subsection B of this section, if completion of the\n\nfederal fingerprint search is the only reason for delay of\n\nregistration of that firearms instructor applicant. Upon receipt of\n\nthe federal fingerprint search information, if the Bureau receives\n\ninformation which precludes the person from having a handgun\n\nlicense, the Bureau shall revoke both the registration and the\n\nhandgun license previously issued to the firearms instructor.\n\nE. The required firearms safety and training course and the\n\nactual demonstration of competency and qualification required of the\n\napplicant shall be designed and conducted in such a manner that the\n\ncourse can be reasonably completed by the applicant within an eight-\n\nhour period. CLEET shall establish the course content and\n\npromulgate rules, procedures and forms necessary to implement the\n\nprovisions of this subsection. For the training and qualification\n\ncourse, an applicant may be charged a fee which shall be determined\napplicant shall be designed and conducted in such a manner that the\n\ncourse can be reasonably completed by the applicant within an eight-\n\nhour period. CLEET shall establish the course content and\n\npromulgate rules, procedures and forms necessary to implement the\n\nprovisions of this subsection. For the training and qualification\n\ncourse, an applicant may be charged a fee which shall be determined\n\nby the instructor or entity that is conducting the course. The\n\nmaximum class size shall be determined by the instructor conducting\n\nthe course; provided, however, practice shooting sessions shall not\n\nhave more than ten participating students at one time. CLEET may\n\nestablish criteria for assistant instructors and any other\n\nrequirements deemed necessary to conduct a safe and effective\n\ntraining and qualification course. The course content shall include\n\na safety inspection of the firearm to be used by the applicant in\n\nthe training course; instruction on pistol handling, safety and\n\nstorage; dynamics of ammunition and firing; methods or positions for\n\nfiring a pistol; information about the criminal provisions of the\n\nOklahoma law relating to firearms; the requirements of the Oklahoma\n\nSelf-Defense Act as it relates to the applicant; self-defense and\n\nthe use of appropriate force; a practice shooting session; and a\n\nfamiliarization course. The firearms instructor shall refuse to\n\ntrain or qualify any person when the pistol to be used or carried by\n\nthe person is either deemed unsafe or unfit for firing or is a\n\nweapon not authorized by the Oklahoma Self-Defense Act. The course\n\nshall provide an opportunity for the applicant to qualify himself or\n\nherself with a pistol; provided, no pistol shall be capable of\n\nfiring larger than .45 caliber ammunition. Any applicant who\n\nsuccessfully trains and qualifies himself or herself with a pistol\n\nshall be approved by the firearms instructor on the training\n\ncertificate. Upon successful completion of the training and\n\nqualification course, a certificate of training and a certificate of\n\ncompetency and qualification shall be issued to each applicant who\n\nsuccessfully completes the course. The certificate of training and\n\ncertificate of competency and qualification shall comply with the\n\nforms established by CLEET and shall be submitted with an\n\napplication for a handgun license pursuant to the provisions of\n\nparagraph 2 of subsection A of Section 1290.12 of this title. The\n\ncertificate of training and certificate of competency and\n\nqualification issued to an applicant shall be valid for a period of\n\nthree (3) years.\n\nF. There is hereby created a revolving fund for the Council on\n\nLaw Enforcement Education and Training (CLEET), to be designated the\n\n“Firearms Instructors Revolving Fund”. The fund shall be a\n\ncontinuing fund, not subject to fiscal year limitations, and shall\n\nconsist of all funds received for approval of firearms instructors\n\nfor purposes of the Oklahoma Self-Defense Act. All funds received\n\nshall be deposited to the fund. All monies accruing to the credit\n\nof the fund are hereby appropriated and may be budgeted and expended\n\nby the Council on Law Enforcement Education and Training, for\n\nimplementation of the training and qualification course contents,\n\napproval of firearms instructors and any other CLEET requirement\n\npursuant to the provisions of the Oklahoma Self-Defense Act or as\n\nmay otherwise be deemed appropriate by CLEET. Expenditures from the\n\nfund shall be made upon warrants issued by the State Treasurer\n\nagainst claims filed as prescribed by law with the Director of the\n\nOffice of Management and Enterprise Services for approval and\n\npayment.\n\nG. Firearms instructors shall keep on file for a period of not\n\nless than three (3) years a roster of each training class, the\n\nsafety test score of each individual, the caliber and the weapon\n\ner\n\nagainst claims filed as prescribed by law with the Director of the\n\nOffice of Management and Enterprise Services for approval and\n\npayment.\n\nG. Firearms instructors shall keep on file for a period of not\n\nless than three (3) years a roster of each training class, the\n\nsafety test score of each individual, the caliber and the weapon\n\neach individual used when qualifying and whether or not each\n\nindividual successfully completed the training course.
