Stat. tit. 21, § 21-1290.17","heading":"Suspension and revocation of license","body":"SUSPENSION AND REVOCATION OF LICENSE\n\nA. The Oklahoma State Bureau of Investigation shall have\n\nauthority pursuant to the provisions of the Oklahoma Self-Defense\n\nAct and any other provision of law to suspend or revoke any handgun\n\nlicense issued pursuant to the provisions of the Oklahoma Self-\n\nDefense Act. A person whose license has been suspended or revoked\n\nor against whom a fine has been assessed shall be entitled to an\n\nappeal through a hearing in accordance with the Administrative\n\nProcedures Act. Any administrative hearing on suspensions,\n\nrevocations or fines shall be conducted by a hearing examiner\n\nappointed by the Bureau. The hearing examiner's decision shall be a\n\nfinal decision appealable to a district court in accordance with the\n\nAdministrative Procedures Act. After a handgun license has been\n\nissued, the discovery of or the occurrence of any condition which\n\ndirectly affects a person's eligibility for a handgun license as\n\nprovided by the provisions of Section 1290.9 or 1290.10 of this\n\ntitle shall require a revocation of the license by the Bureau. The\n\ndiscovery of or the occurrence of any condition pursuant to Section\n\n1290.11 of this title, after a license has been issued, shall cause\n\na suspension of the handgun license for a period of time as\n\nprescribed for the condition. Any provision of law that requires a\n\nrevocation of a handgun license upon a conviction shall cause the\n\nBureau to suspend the handgun license upon the discovery of the\n\narrest of the person for such offense until a determination of the\n\ncriminal case at which time the Bureau shall proceed with the\n\nappropriate administrative action. A licensee may voluntarily\n\nsurrender a license to the Oklahoma State Bureau of Investigation at\n\nany time. Such surrender of a handgun license will render the\n\nlicense invalid. Nothing in this section may be interpreted to\n\nprevent a subsequent new application for a license. The licensee\n\nshall be informed and acknowledge in writing as follows:\n\n1. The licensee understands that the voluntary surrender of the\n\nlicense will not be deemed a suspension or revocation by the Bureau;\n\n2. A voluntary surrender of a license will not be reviewable by\n\na hearing examiner or subject to judicial review under the\n\nAdministrative Procedures Act; and\n\n3. By surrendering the license, the licensee shall forfeit all\n\nfees paid to date.\n\nB. Any handgun license which is subsequently suspended or\n\nrevoked shall be immediately returned to the Oklahoma State Bureau\n\nof Investigation upon notification. Any person refusing or failing\n\nto return a license after notification of its suspension or\n\nrevocation shall, upon conviction, be guilty of a misdemeanor\n\npunishable by a fine of not exceeding Five Hundred Dollars\n\n($500.00), by imprisonment in the county jail for not exceeding six\nuspended or\n\nrevoked shall be immediately returned to the Oklahoma State Bureau\n\nof Investigation upon notification. Any person refusing or failing\n\nto return a license after notification of its suspension or\n\nrevocation shall, upon conviction, be guilty of a misdemeanor\n\npunishable by a fine of not exceeding Five Hundred Dollars\n\n($500.00), by imprisonment in the county jail for not exceeding six\n\n(6) months, or by both such fine and imprisonment. In addition, the\n\nperson shall be subject to an administrative fine of Five Hundred\n\nDollars ($500.00), upon a hearing and determination by the Bureau\n\nthat the person is in violation of the provisions of this\n\nsubsection.\n\nC. Any law enforcement officer of this state shall confiscate a\n\nhandgun license in the possession of any person and return it to the\n\nOklahoma State Bureau of Investigation for appropriate\n\nadministrative proceedings against the licensee when the license is\n\nno longer needed as evidence in any criminal proceeding, as follows:\n\n1. Upon the arrest of the person for any felony offense;\n\n2. Upon the arrest of the person for any misdemeanor offense\n\nenumerated as a preclusion to a handgun license;\n\n3. For any violation of the provisions of the Oklahoma Self-\n\nDefense Act;\n\n4. When the officer has been called to assist or is\n\ninvestigating any situation which would be a preclusion to having a\n\nhandgun license; or\n\n5. As provided in subsection D of Section 1290.8 of this title.\n\nD. Any administrative fine assessed in accordance with the\n\nprovisions of the Oklahoma Self-Defense Act shall be paid in full\n\nwithin thirty (30) days of assessment. The Oklahoma State Bureau of\n\nInvestigation shall, without a hearing, suspend the handgun license\n\nof any person who fails to pay in full any administrative fine\n\nassessed against the person in accordance with the provisions of\n\nthis subsection. The suspension of any handgun license shall be\n\nautomatic and shall begin thirty (30) days from the date of the\n\nassessment of the administrative fine. The suspension shall be\n\nremoved and the handgun license returned to its prior standing upon\n\npayment of the administrative fine being paid in full to the Bureau.\n\nE. Whenever a handgun license has been suspended in accordance\n\nwith the provisions of this act or the administrative rules of the\n\nBureau promulgated for purposes of this act, the license shall\n\nremain under suspension and shall not be reinstated until:\n\n1. The person whose license has been suspended applies for\n\nreinstatement in accordance with the administrative rules of the\n\nBureau. The Bureau shall not charge any fee in conjunction with an\n\napplication for a license reinstatement. The person whose license\n\nhas been suspended must demonstrate that the condition or preclusion\n\nwhich was the basis for the suspension has lapsed and is no longer\n\nin effect; and\n\n2.
