Stat. tit. 21, § 21-1321.4","heading":"Acts which may be proclaimed prohibited - Actions at","body":"law or in equity.\n\nA. The Governor during the existence of a state of emergency,\n\nby proclamation, may, in the area described by the proclamation,\n\nwhich proclamation shall not cover any part or portion of the state\n\nnot affected by public disorder, disaster, or riot at the time the\n\nproclamation is issued, prohibit:\n\n1. Any person being on the public streets, or in the public\n\nparks or at any other public place during the hours declared by the\n\nGovernor to be a period of curfew;\n\n2. A designated number of persons, as designated by the\n\nGovernor, from assembling or gathering on the public streets, parks,\n\nor other open areas of this state, either public or private;\n\n3. The manufacture, transfer, use, possession or transportation\n\nof a molotov cocktail or any other device, instrument or object\n\ndesigned to explode or produce uncontained combustion;\n\n4. The transporting, possessing or using of gasoline, kerosene,\n\nor combustible, flammable, or explosive liquids or materials in a\n\nglass or uncapped container of any kind except in connection with\n\nthe normal operation of motor vehicles, normal home use or\n\nlegitimate commercial use;\n\n5. The sale, purchase or dispensing of alcoholic beverages;\n\n6. The sale, purchase or dispensing of other commodities or\n\ngoods, as the Governor reasonably believes should be prohibited to\n\nhelp preserve and maintain life, health, property or the public\n\npeace;\n\n7. The use of certain streets, highways or public ways by the\n\npublic; and\n\n8. Such other activities as the Governor reasonably believes\n\nshould be prohibited to help preserve and maintain life, health,\n\nproperty or the public peace.\n\nB. Notwithstanding this section or any other law of this state,\n\nneither the Governor nor any official of a municipal or state entity\n\nshall prohibit or suspend the sale, ownership, possession,\n\ntransportation, carrying, transfer and storage of firearms,\n\nammunition and ammunition accessories during a declared state of\n\nemergency, that are otherwise legal under state law.\n\nC. In imposing the restrictions provided for by the Oklahoma\n\nRiot Control and Prevention Act, the Governor may impose them for\n\nsuch times, upon such conditions, with such exceptions and in such\n\nareas of this state the Governor from time to time deems necessary.\n\nD. Any individual aggrieved by a violation of subsection B of\n\nthis section may seek relief in an action at law or in equity for\n\nredress against any person who subjects such individual or causes\n\nsuch individual to be subjected to an action prohibited by\n\nsubsection B of this section. In addition to any other remedy at\n\nlaw or in equity, an individual aggrieved by the seizure or\n\nconfiscation of a firearm or ammunition in violation of subsection B\n\nof this section may bring an action for the return of such firearm\n\nor ammunition in the district court of the county in which that\n\nindividual resides or in which such firearm or ammunition is\n\nlocated.
