Stat. tit. 21, § 21-1321.8","heading":"Provisions applicable during state of emergency","body":"The following provisions shall apply during a state of\n\nemergency.\n\nA. A person is guilty of riot when he participates with two or\n\nmore persons in a course of disorderly conduct:\n\n1. With intent to commit or facilitate the commission of a\n\nfelony or misdemeanor;\n\n2. With intent to prevent or coerce official action; or\n\n3. When the accused or any other participant to the knowledge\n\nof the accused uses or plans to use a firearm or other deadly\n\nweapon.\n\nB. Any person upon any public way within the described area who\n\nis directed by the authorities to leave the public way but refuses\n\nto do so shall be guilty of a misdemeanor.\n\nC. Any person who violates the provisions of this section,\n\nexcept subsection B of this section, shall be guilty of a Class B4\n\nfelony offense, and upon conviction thereof shall be imprisoned for\n\nnot less than two (2) years nor more than ten (10) years.\n\nD. Any person sixteen (16) years of age or over who violates\n\nthe provisions of this section shall be prosecuted as an adult.\n\nE. A person is guilty of a Class B4 felony offense under this\n\nsection committed by another person when:\n\n1. Acting with the state of mind that is sufficient for\n\ncommission of the offense, he causes an innocent or irresponsible\n\nperson to engage in conduct constituting the offense;\n\n2. Intending to promote or facilitate the commission of the\n\noffense he:\n\na. solicits, requests, commands, importunes, or otherwise\n\nattempts to cause the other person to commit it,\n\nb. aids, counsels, or agrees or attempts to aid the other\n\nperson in planning or committing it, or\n\nc. having a legal duty to prevent the commission of the\n\noffense, fails to make a proper effort to do so; or\n\n3. The person's conduct is expressly declared by a statute of\n\nthis state to establish the person's complicity.\n\nF. In any prosecution for an offense under this section in\n\nwhich the criminal liability of the accused is based upon the\n\nconduct of another person pursuant to this section, it is no defense\n\nthat:\n\n1. The other person is not guilty of the offense in question\n\nbecause of irresponsibility or other legal incapacity or exemption,\n\nor because of unawareness of the criminal nature of the conduct in\n\nquestion or of the accused's criminal purpose, or because of other\n\nfactors precluding the mental state required for the commission of\n\nthe offense; or\n\n2. The other person has not been prosecuted for or convicted of\n\nany offense based on the conduct in question, or has previously been\n\nacquitted thereof, or has been convicted of a different offense or\n\nin a different degree, or has legal immunity from prosecution for\n\nthe conduct in question.\n\nG. “Disorderly conduct” as used in this section means a course\n\nof conduct by a person who:\n\n1. Causes public inconvenience, annoyance, or alarm, or\n\nrecklessly creates a risk thereof, by:\n\na. engaging in fighting or in violent, tumultuous, or\n\nthreatening behavior,\n\nb. making an unreasonable noise or an offensively coarse\n\nutterance, gesture, or display, or addressing abusive\n\nlanguage to any person present,\n\nc. dispersing any lawful procession or meeting of\n\npersons, not being a peace officer of this state and\n\nwithout lawful authority, or\n\nd. creating a hazardous or physically offensive condition\n\nwhich serves no legitimate purpose; or\n\n2.
