Stat. tit. 21, § 21-142.10","heading":"Award of compensation - Criteria - Amount - Denial,","body":"withdrawal or reduction - Reconsideration.\n\nA. Compensation shall not be awarded:\n\n1. Unless the claim has been filed with the Crime Victims\n\nCompensation Board within thirty (30) months after the injury or\n\ndeath upon which the claim is based. If the victim is under a\n\nmental or cognitive disability or is a child under eighteen (18)\n\nyears of age, the Board may use the date the criminal incident was\n\ndisclosed to a responsible adult when establishing whether or not\n\nthe claim was timely filed. In cases involving sexual assault of an\n\nadult eighteen (18) years of age or older, the Board may use the\n\ndate the sexual assault forensic evidence kit was tested when\n\nestablishing whether the claim was timely filed. The Board may, at\n\nits discretion, extend the filing period beyond one (1) year upon a\n\nshowing of good cause or in all cases of sexual assault;\n\n2. To a claimant who was the offender, or an accomplice of the\n\noffender;\n\n3. To another person if the award would unjustly benefit the\n\noffender or accomplice; or\n\n4. Unless after the criminally injurious conduct resulting in\n\ninjury or death:\n\na. such conduct was reported to a law enforcement officer\n\nwithin seventy-two (72) hours after its occurrence,\n\nb. in the case of sexual assault, the victim undergoes a\n\nforensic medical examination within one hundred twenty\n\n(120) hours after its occurrence, or\n\nc. the Board finds there was good cause for the failure\n\nto report the crime or obtain a forensic medical\n\nexamination within the time specified in subparagraph\n\na or b of this paragraph.\n\nB. Compensation otherwise payable to a claimant shall be\n\ndiminished to the extent:\n\n1. That the economic loss is recouped from collateral sources;\n\nor\n\n2. Of the degree of responsibility for the cause of the injury\n\nor death attributable to the victim as determined by the Board.\n\nProvided, a self-inflicted injury shall not be attributable to the\n\nvictim when the Board finds the injury is a direct result of the\n\ncrime committed against the victim.\n\nC. The Board, upon finding that the claimant or victim has not\n\nfully cooperated with appropriate law enforcement agencies, may\n\ndeny, withdraw or reduce an award of compensation. Victims of\n\nsexual assault who undergo a forensic medical examination within one\n\nhundred twenty (120) hours after the sexual assault shall be found\n\nto have fully cooperated. The Board may extend this period of time\n\nfor good cause.\n\nD. The Board, on its own motion or on request of the claimant,\n\nmay reconsider a decision granting or denying an award or\n\ndetermining its amount. The motion or request to reconsider a\n\ndecision shall be made within six (6) months from the date of the\n\nlast action by the Board on the claim at issue. An order on\n\nreconsideration of an award shall not require a refund of amounts\n\npreviously paid unless the award was obtained by fraud. The right\n\nof reconsideration does not affect the finality of a Board decision\n\nfor the purpose of judicial review. On claims which are denied by\n\nthe Board, reconsideration may only be granted within six (6) months\n\nof the last Board action.\n\nE.
