A Sexual Assault Examination Fund shall be established for\n\nthe purpose of providing to a victim of a sexual assault a forensic\n\nmedical examination by a qualified licensed health care professional\n\nand to provide to the victim medications as directed by the health\n\ncare professional.\n\nB. As used in this section:\n\n1. “Sexual assault” means:\n\na. rape, or rape by instrumentation, as defined in\n\nSections 1111, 1111.1 and 1114 of this title, or\n\nb. forcible sodomy, as defined in Section 888 of this\n\ntitle; and\n\n2. “Qualified licensed health care professional” means a\n\nphysician, registered nurse, or other licensed health care\n\nprofessional qualified by training and experience to perform sexual\n\nassault examinations.\n\nC. The Crime Victims Compensation Board is authorized to pay\n\nfor this examination and the medications directed by the qualified\n\nlicensed health care professional upon application submitted by the\n\nvictim of a sexual assault.\n\nD. The Crime Victims Compensation Board shall establish the\n\nprocedures for disbursement of the Sexual Assault Examination Fund,\n\nbut in no event shall the Crime Victims Compensation Board pay an\n\namount to exceed:\n\n1. Eight Hundred Dollars ($800.00) for a sexual assault\n\nexamination; and\n\n2. One Hundred Dollars ($100.00) for medications which are\n\nrelated to the sexual assault and directed and deemed necessary by\n\nthe health care professional.\n\nSuch payments shall not exceed the amounts specified by this\n\nsubsection regardless of the amount of any individual bills\n\ncomprising the claim. Payments shall be made only upon claims\n\nsigned by the victim or guardian and health care professional.\n\nE. The District Attorneys Council is hereby authorized to\n\ntransfer funds, as specified in the appropriations bill annually,\n\nfrom the Crime Victims Compensation Fund to the Sexual Assault\n\nExamination Fund for the payment of sexual assault forensic\n\nexaminations and medications, pursuant to this section.\n\nF.
