Stat. tit. 21, § 21-142A-1","heading":"Definitions","body":"For purposes of the Oklahoma Victim's Rights Act:\n\n1. \"Crime victim\" or \"victim\" means any person against whom a\n\ncrime or delinquent act was committed or a person directly and\n\nproximately harmed by the commission of a crime or delinquent act,\n\nexcept homicide, in which case the victim may be a surviving family\n\nmember including a stepbrother, stepsister or stepparent, or the\n\nestate when there are no surviving family members other than the\n\ndefendant, and who, as a direct result of the crime, suffers injury,\n\nloss of earnings, out-of-pocket expenses, or loss or damage to\n\nproperty, and who is entitled to restitution from an offender\n\npursuant to an order of restitution imposed by a sentencing court\n\nunder the laws of this state. The term \"victim\" does not include\n\nthe accused or a person whom the court finds would not act in the\n\nbest interests of a person who is deceased or incompetent, a minor\n\nor an incapacitated victim;\n\n2. \"Injury\" means any physical, mental, or emotional harm\n\ncaused by the conduct of an offender and includes the expenses\n\nincurred for medical, psychiatric, psychological, or generally\n\naccepted remedial treatment of the actual bodily or mental harm,\n\nincluding pregnancy and death, directly resulting from a crime and\n\naggravation of existing physical injuries, if additional losses can\n\nbe attributed to the direct result of the crime;\n\n3. \"Loss of earnings\" means the deprivation of earned income or\n\nof the ability to earn previous levels of income as a direct result\n\nof a crime and the loss of the cash equivalent of Social Security,\n\nrailroad retirement, pension plan, retirement plan, disability,\n\nveteran's retirement, court-ordered child support or court-ordered\n\nspousal support, where the payment is the primary source of the\n\nvictim's income, and where the victim is deprived of the money as a\n\ndirect result of the crime;\n\n4. \"Members of the immediate family\" means the spouse, a child\n\nby birth or adoption, a stepchild, a parent by birth or adoption, a\n\nstepparent, a grandparent, a grandchild, a sibling, or a stepsibling\n\nof each victim;\n\n5. \"Out-of-pocket loss\" means the unreimbursed and\n\nnonreimbursable expenses or indebtedness incurred for medical care,\n\nnonmedical care, or other services necessary for the treatment of\n\nthe actual bodily or mental harm, including pregnancy and funeral\n\nexpenses, directly resulting from the crime and aggravation of\n\nexisting physical injuries, if additional losses can be attributed\n\ndirectly to the crime; the unreimbursed and nonreimbursable expenses\n\nfor damage to real and personal property as a direct result of the\n\ncrime, and unreimbursed and nonreimbursable economic losses incurred\n\nas a consequence of participation in prosecution and proceedings\n\nrelated to the crime;\n\n6. \"Property\" means any real or personal property;\n\n7. \"Restitution\" means the return of property to the crime\n\nvictim or payments in cash or the equivalent thereof, and payment in\n\ncash or the equivalent thereof as reparation for injury, loss of\n\nearnings, and out-of-pocket loss ordered by the court in the\n\ndisposition of a criminal proceeding;\n\n8. \"Victim impact statements\" means information about the\n\nfinancial, emotional, psychological, and physical effects of a\n\nviolent crime on each victim and members of their immediate family,\n\nor person designated by the victim or by family members of the\n\nvictim and includes information about the victim, circumstances\n\nsurrounding the crime, the manner in which the crime was\n\nperpetrated, and the opinion of the victim of a recommended\n\nsentence; and\n\n9. \"Violent crime\" means any crime listed in paragraph 2 of\n\nSection 571 of Title 57 of the Oklahoma Statutes or any attempt,\n\nconspiracy or solicitation to commit any such crime or the crime of\n\nnegligent homicide pursuant to Section 11-903 of Title 47 of the\n\nOklahoma Statutes or the crime of causing great bodily injury while\ntrated, and the opinion of the victim of a recommended\n\nsentence; and\n\n9. \"Violent crime\" means any crime listed in paragraph 2 of\n\nSection 571 of Title 57 of the Oklahoma Statutes or any attempt,\n\nconspiracy or solicitation to commit any such crime or the crime of\n\nnegligent homicide pursuant to Section 11-903 of Title 47 of the\n\nOklahoma Statutes or the crime of causing great bodily injury while\n\ndriving under the influence of intoxicating substance pursuant to\n\nSection 11-904 of Title 47 of the Oklahoma Statutes.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c1a30ed179e39f8163a60bde17958839c2790b82f0c99223c9e0020eaef2f31b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-142a","next":"us-ok/okla.-stat.-tit.-21-21-142a-10"},"notice":"GroundRules: Original legal text.
