Every person who, under circumstances not amounting to any\n\nburglary, enters any building or part of any building, booth, tent,\n\nwarehouse, railroad car, vessel, or other structure or erection with\n\nintent to commit any felony, larceny, or malicious mischief, is\n\nguilty of a misdemeanor.\n\nB. Every person who, without the intention to commit any crime\n\ntherein, shall willfully and intentionally break and enter into any\n\nbuilding, trailer, vessel or other premises used as a dwelling\n\nwithout the permission of the owner or occupant thereof, except in\n\nthe cases and manner allowed by law, shall be guilty of a\n\nmisdemeanor.\n\nC. Every person who, with the intent to commit a crime, enters\n\nan area of a commercial business that is:\n\n1. Commonly reserved for personnel of the commercial business\n\nwhere money or other property is kept; or\n\n2. Clearly marked with a sign or signs that indicates to the\n\npublic that entry is forbidden,\n\nshall, upon conviction, be guilty of a misdemeanor punishable by\n\nimprisonment in the county jail for a term of not more than one (1)\n\nyear, or a fine of not more than Five Hundred Dollars ($500.00), or\n\nby both such fine and imprisonment. Any second or subsequent\n\nconviction under the provisions of this subsection shall be a felony\n\npunishable by imprisonment in the custody of the Department of\n\nCorrections for a term of not more than two (2) years, or by a fine\n\nof not more than One Thousand Dollars ($1,000.00), or by both such\n\nfine and imprisonment.\n\nR.L. 1910, § 2618.
