Stat. tit. 21, § 21-152","heading":"Persons capable of committing crimes - Exceptions -","body":"Children – Intellectual disability - Ignorance - Commission without\n\nconsciousness - Involuntary subjection.\n\nAll persons are capable of committing crimes, except those\n\nbelonging to the following classes:\n\n1. Children under the age of seven (7) years;\n\n2. Children over the age of seven (7) years, but under the age\n\nof fourteen (14) years, in the absence of proof that at the time of\n\ncommitting the act or neglect charged against them, they knew its\n\nwrongfulness;\n\n3. Persons who are impaired by reason of an intellectual\n\ndisability upon proof that at the time of committing the act charged\n\nagainst them they were incapable of knowing its wrongfulness;\n\n4. Mentally ill persons, and all persons of unsound mind,\n\nincluding persons temporarily or partially deprived of reason, upon\n\nproof that at the time of committing the act charged against them\n\nthey were incapable of knowing its wrongfulness;\n\n5. Persons who committed the act, or made the omission charged,\n\nunder an ignorance or mistake of fact which disproves any criminal\n\nintent. But ignorance of the law does not excuse from punishment\n\nfor its violation;\n\n6. Persons who committed the act charged without being\n\nconscious thereof; and\n\n7. Persons who committed the act, or make the omission charged,\n\nwhile under involuntary subjection to the power of superiors.\n\nR.L. 1910, § 2094. Amended by Laws 1998, c. 246, § 11, eff.
