It is unlawful for any person to willfully and with\n\nfraudulent intent obtain the name, address, Social Security number,\n\ndate of birth, place of business or employment, debit, credit or\n\naccount numbers, driver license number or any other personal\n\nidentifying information of another person, living or dead, with\n\nintent to use, sell or allow any other person to use or sell such\n\npersonal identifying information to obtain or attempt to obtain\n\nmoney, credit, goods, property or service in the name of the other\n\nperson without the consent of that person.\n\nB. It is unlawful for any person to use with fraudulent intent\n\nthe personal identity of another person, living or dead, or any\n\ninformation relating to the personal identity of another person,\n\nliving or dead, to obtain or attempt to obtain credit or anything of\n\nvalue.\n\nC. It is unlawful for any person with fraudulent intent to\n\nlend, sell, or otherwise offer the use of such person's own name,\n\naddress, Social Security number, date of birth or any other personal\n\nidentifying information or document to any other person with the\n\nintent to allow such other person to use the personal identifying\n\ninformation or document to obtain or attempt to obtain any\n\nidentifying document in the name of such other person.\n\nD. It is unlawful for any person to willfully create, modify,\n\nalter or change any personal identifying information of another\n\nperson with fraudulent intent to obtain any money, credit, goods,\n\nproperty, service or any benefit or thing of value, or to control,\n\nuse, waste, hinder or encumber another person's credit, accounts,\n\ngoods, property, title, interests, benefits or entitlements without\n\nthe consent of that person.\n\nE. Any person convicted of violating any provision of this\n\nsection shall be guilty of identity theft. Any person who violates\n\nthe provisions of subsection A, B or D of this section shall, upon\n\nconviction, be guilty of a Class D1 felony offense punishable by\n\nimprisonment as provided for in subsections B through F of Section\n\n20N of this title, or a fine not to exceed One Hundred Thousand\n\nDollars ($100,000.00), or by both such fine and imprisonment. Any\n\nperson who violates the provisions of subsection A, B or D of this\n\nsection, and the victim is an individual who is less than eighteen\n\n(18) years of age, shall, upon conviction, be guilty of a Class D1\n\nfelony offense punishable by imprisonment as provided for in\n\nsubsections B through F of Section 20N of this title, or a fine not\n\nto exceed One Hundred Thousand Dollars ($100,000.00), or by both\n\nsuch fine and imprisonment. Any person who violates the provisions\n\nof subsection C of this section shall, upon conviction, be guilty of\n\na misdemeanor punishable by imprisonment in the county jail for a\n\nterm not to exceed one (1) year, or a fine not to exceed One Hundred\n\nThousand Dollars ($100,000.00), or by both such fine and\n\nimprisonment. Restitution to the victim may be ordered in addition\n\nto any criminal penalty imposed by the court.
