A person commits title theft when he or she:\n\n1. Intentionally alters, falsifies, forges, or misrepresents a\n\ndocument pertaining to real property, with the intent to deceive,\n\ndefraud, or unlawfully transfer or encumber the ownership rights of\n\nthe owner of the real property;\n\n2. With intent to defraud, misrepresents himself or herself as\n\nthe owner or authorized representative of the owner of real property\n\nto induce another person to rely on such false information to obtain\n\nownership or possession of such real property; or\n\n3. With intent to defraud, takes, obtains, steals, encumbers,\n\nor transfers title or an interest in real property by fraud,\n\nforgery, larceny, or any other fraudulent or deceptive practice.\n\nB. A person who procures, files, or causes to be filed of\n\npublic record any document pertaining to an interest in real\n\nproperty with intent to deceive another person as to the veracity of\n\nthe document recorded shall be, upon conviction, guilty of a felony\n\npunishable by imprisonment in the custody of the Department of\n\nCorrections for a term not to exceed three (3) years, a fine not to\n\nexceed Five Thousand Dollars ($5,000.00), or by both such\n\nimprisonment and fine. Additionally, the court shall order\n\nrestitution to be paid to the aggrieved party as authorized by\n\nSection 991f of Title 22 of the Oklahoma Statutes.\n\nC. A person who knowingly and willfully procures, files, or\n\ncauses to be filed of public record a document pertaining to real\n\nproperty in this state with intent to defraud the owner of the real\n\nproperty or the owner of an interest in the real property shall be,\n\nupon conviction, guilty of a felony punishable by imprisonment in\n\nthe custody of the Department of Corrections for a term not to\n\nexceed ten (10) years, a fine not to exceed Five Thousand Dollars\n\n($5,000.00), or by both such imprisonment and fine. Additionally,\n\nthe court shall order restitution to be paid to the aggrieved party\n\nas authorized by Section 991f of Title 22 of the Oklahoma Statutes.\n\nD.
