Any person who, while in the commission or attempted\n\ncommission of a felony, has in his possession or under his control a\n\nfirearm, the factory serial number or identification number of which\n\nhas been removed, defaced, altered, obliterated or mutilated in any\n\nmanner, upon conviction, shall be guilty of a Class D1 felony\n\noffense punishable by imprisonment as provided for in subsections B\n\nthrough F of Section 20N of this title, or by a fine of not less\n\nthan One Thousand Dollars ($1,000.00) nor more than Ten Thousand\n\nDollars ($10,000.00), or by both such fine and imprisonment.\n\nB. Any person who removes, defaces, alters, obliterates or\n\nmutilates in any manner the factory serial number or identification\n\nnumber of a firearm, or in any manner participates therein, upon\n\nconviction, shall be guilty of a misdemeanor punishable by\n\nimprisonment in the county jail for not to exceed one (1) year, or\n\nby a fine of not to exceed One Thousand Dollars ($1,000.00), or by\n\nboth such fine and imprisonment.\n\nC. 1. Upon a conviction of a violation of this section, the\n\ncourt clerk, sheriff, peace officer or other person having custody\n\nof the firearm shall immediately deliver the firearm to the\n\nCommissioner of Public Safety, who shall preserve the firearm\n\npending an order of the court.\n\n2. At the conclusion of a trial or proceeding for a violation\n\nof this section, if a finding is made that the factory serial number\n\nor identification number of the firearm has been removed, defaced,\n\naltered, obliterated or mutilated, the court shall issue a written\n\norder to the Commissioner of Public Safety for destruction of the\n\nfirearm, unless the defendant files a timely motion to preserve the\n\nfirearm pending appeal.
