Stat. tit. 21, § 21-1550.27","heading":"Falsely manufactured or altered credit and debit cards","body":"— Penalties.\n\nA. A person, with intent to defraud:\n\n1. A purported issuer;\n\n2. A person or organization providing money, goods, services or\n\nanything else of value; or\n\n3. Any other person,\n\nwho falsely makes, clones, or alters a purported credit, debit, or\n\nsimilar card containing a magnetic stripe capable of storing data,\n\nin any form, either physically or digitally, from what the original\n\nissuer placed on the card or utters such a card is guilty of a\n\nfelony.\n\nB. 1. A person other than the purported issuer who possesses\n\nany credit, debit, or similar card containing a magnetic stripe\n\ncapable of storing data, which is falsely made, cloned, or altered\n\nin any form, either physically or digitally from what the issuer\n\nroutinely incorporates, is presumed to have violated this section.\n\n2. The possession of three or more credit, debit, or similar\n\ncards containing magnetic stripes capable of storing data containing\n\ncloned or altered data simultaneously shall create a rebuttable\n\npresumption that the person is possessing such cards with the intent\n\nto defraud, for purposes of this section.\n\nC. A person \"falsely makes\" a credit, debit, or similar card\n\ncontaining a magnetic stripe capable of storing data when the person\n\nmarks, alters, or stores information in whole or in part, in a\n\nphysical or digital format, on a device or instrument which can\n\nfunction as a credit, debit, or similar card of an issuer but which\n\nis not such a card because the issuer did not authorize the marks,\n\nalterations, or stored information, or when the person alters a\n\ncredit, debit, or similar card containing a magnetic stripe capable\n\nof storing data which was originally authorized and issued,\n\nincluding, but not limited to, when a person manipulates information\n\nincluded on an electronic magnetic stripe or chip contained on a\n\ncard.\n\nD. A person in violation of the provisions of this section,\n\nwhile in possession of:\n\n1. Five or fewer falsely made cards shall, upon conviction, be\n\nguilty of a felony punishable by imprisonment in the custody of the\n\nDepartment of Corrections for a term of not less than two (2) years\n\nand not more than five (5) years, and by a fine not to exceed Five\n\nThousand Dollars ($5,000.00);\n\n2. Six or more but less than twenty (20) falsely made cards\n\nshall, upon conviction, be guilty of a felony punishable by\n\nimprisonment in the custody of the Department of Corrections for a\n\nterm of not less than five (5) years and not more than ten (10)\n\nyears, and by a fine not to exceed Ten Thousand Dollars\n\n($10,000.00); and\n\n3.
