As used in this section and Section 1550.42 of this title,\n\n\"identification document\", \"identification card\", or \"identification\n\ncertificate\" means any printed form which contains:\n\n1. The name and photograph of a person;\n\n2. The name and any physical description of a person;\n\n3. The name and social security number of a person; or\n\n4. Any combination of information provided for in paragraphs 1\n\nthrough 3 of this subsection; and\n\nwhich by its format, is capable of leading a person to believe said\n\ndocument, card, or certificate has been issued for the purpose of\n\nidentifying the person named thereon, but shall not include any\n\nprinted form which, on its face, conspicuously bears the term \"NOT\n\nFOR IDENTIFICATION\" in not less than six-point type.\n\nB. It is a misdemeanor for any person:\n\n1. To purchase an identification document, identification card,\n\nor identification certificate which bears altered or fictitious\n\ninformation concerning the date of birth, sex, height, eye color,\n\nweight, a fictitious or forged name or signature or a photograph of\n\nany person, other than the person named thereon;\n\n2. To display or cause or permit to be displayed or to\n\nknowingly possess an identification document, identification card or\n\nidentification certificate which bears altered or fictitious\n\ninformation concerning the date of birth, sex, height, eye color,\n\nweight, or fictitious or forged name or signature or a photograph of\n\nany person, other than the person named thereon;\n\n3. To display or cause or permit to be displayed or to\n\nknowingly possess any counterfeit or fictitious identification\n\ndocument, identification card, or identification certificate; or\n\n4. To use the \"Great Seal of the State of Oklahoma\" or\n\nfacsimile thereof, on any identification document, identification\n\ncard, or identification certificate which is not issued by an entity\n\nof this state or political subdivision thereof, or by the United\n\nStates. Provided, nothing in this paragraph shall be construed to\n\nprohibit the use of the \"Great Seal of the State of Oklahoma\" for\n\nauthorized advertising, including, but not limited to, business\n\ncards, calling cards and stationery.\n\nC. It is a Class D1 felony offense for any person:\n\n1. To create, publish or otherwise manufacture an\n\nidentification document, identification card or identification\n\ncertificate or facsimile thereof, or to create, manufacture or\n\npossess an engraved plate or other such device for the printing of\n\nan identification document, identification card or identification\n\ncertificate or facsimile thereof, which purports to identify the\n\nbearer of such document, card, or certificate whether or not\n\nintended for use as identification, and includes, but is not limited\n\nto, documents, cards, and certificates purporting to be driver\n\nlicenses, nondriver identification cards, birth certificates, social\n\nsecurity cards, and employee identification cards, except as\n\nauthorized by state or federal law;\n\n2. To sell or offer for sale an identification document,\n\nidentification card, or identification certificate or facsimile\n\nthereof, which purports to identify the bearer of such document,\n\ncard, or certificate whether or not intended for use as\n\nidentification, and includes, but is not limited to, documents,\n\ncards, and certificates purporting to be driver licenses, nondriver\n\nidentification cards, birth certificates, social security cards, and\n\nemployee identification cards, except as authorized by state or\n\nfederal law; or\n\n3. To display or present an identification document,\n\nidentification card or identification certificate which bears\n\naltered, false or fictitious information for the purpose of:\n\na. committing or aiding in the commission of a felony in\n\nany commercial or financial transaction,\n\nb. misleading a peace officer in the performance of\n\nduties, or\n\nc. avoiding prosecution.\nd by state or\n\nfederal law; or\n\n3. To display or present an identification document,\n\nidentification card or identification certificate which bears\n\naltered, false or fictitious information for the purpose of:\n\na. committing or aiding in the commission of a felony in\n\nany commercial or financial transaction,\n\nb. misleading a peace officer in the performance of\n\nduties, or\n\nc. avoiding prosecution.\n\nD. 1. The violation of any of the provisions of subsection B\n\nof this section shall constitute a misdemeanor and, upon conviction\n\nthereof, shall be punishable by a fine of not less than Twenty-five\n\nDollars ($25.00), nor more than Two Hundred Dollars ($200.00).\n\n2. The violation of any of the provisions of subsection C of\n\nthis section shall constitute a Class D1 felony offense and, upon\n\nconviction thereof, shall be punishable by a fine not exceeding Ten\n\nThousand Dollars ($10,000.00), or a term of imprisonment as provided\n\nfor in subsections B through F of Section 20N of this title, or by\n\nboth such fine and imprisonment.\n\nE. Notwithstanding any provision of this section, the chief\n\nadministrator of a federal or state law enforcement, military, or\n\nintelligence agency may request the Commissioner of the Department\n\nof Public Safety or State Commissioner of Health to authorize the\n\nissuance of an identification document, identification card, or\n\nidentification certificate within the scope of their authority which\n\nwould otherwise be a violation of this section, to identify a law\n\nenforcement officer or agent as another person for the sole purpose\n\nof aiding in a criminal investigation or a military or intelligence\n\noperation. A person displaying or possessing such identification\n\nshall not be prosecuted for a violation of this section.
