Any person who commits workers' compensation fraud, upon\n\nconviction, shall be guilty of a Class D1 felony offense punishable\n\nby imprisonment as provided for in subsections B through F of\n\nSection 20N of this title, or by a fine not exceeding Ten Thousand\n\nDollars ($10,000.00), or by both such fine and imprisonment. Any\n\nperson who commits workers’ compensation fraud and who has a prior\n\nfelony conviction of workers’ compensation fraud shall receive a\n\ntwo-year penalty enhancement for each prior conviction in addition\n\nto the sentence provided above.\n\nB. For the purposes of this section, workers' compensation\n\nfraud shall include, but not be limited to, any act or omission\n\nprohibited by subsection C of this section and committed by a person\n\nwith the intent to injure, defraud or deceive another with respect\n\nto any of the following:\n\n1. A claim for payment or other benefit pursuant to a contract\n\nof insurance;\n\n2. An application for the issuance of a contract of insurance;\n\n3. The rating of a contract of insurance or any risk associated\n\nwith the contract;\n\n4. Premiums paid on any contract of insurance whether or not\n\nthe contract was actually issued;\n\n5. Payments made in accordance with the terms of a contract of\n\ninsurance;\n\n6. An application for any license which is required by the\n\nOklahoma Insurance Code, Title 36 of the Oklahoma Statutes;\n\n7. An application for a license which is required for the\n\norganization, operation or maintenance of a health maintenance\n\norganization pursuant to Section 2501 et seq. of Title 63 of the\n\nOklahoma Statutes;\n\n8. A request for any approval, license, permit or permission\n\nrequired by the Workers' Compensation Act, by the rules of the\n\nWorkers' Compensation Court or by the rules of the Workers'\n\nCompensation Court Administrator necessary to secure compensation as\n\nrequired by Section 61 of Title 85 of the Oklahoma Statutes;\n\n9. The financial condition of an insurer or purported insurer;\n\n10. The acquisition of any insurer; or\n\n11. A contract of insurance or a Certification of Non-Coverage\n\nUnder the Workers' Compensation Act.\n\nC. A person is guilty of workers' compensation fraud who:\n\n1. Presents, causes to be presented or intends to present to\n\nanother, any statement as part of or in support of any of the\n\npurposes described in subsection B of this section knowing that such\n\nstatement contains any false, fraudulent, incomplete or misleading\n\ninformation concerning any fact or thing material to the purpose for\n\nthe statement;\n\n2. Assists, abets, solicits or conspires with another to\n\nprepare or make any statement that is intended to be presented to,\n\nused by or relied upon by another in connection with or in support\n\nof any of the purposes described in subsection B of this section\n\nknowing that such statement contains any false, fraudulent,\n\nincomplete or misleading information concerning any fact or thing\n\nmaterial to the purpose of the statement;\n\n3. Conceals, attempts to conceal or conspires to conceal any\n\ninformation concerning any fact material to any of the purposes\n\ndescribed in subsection B of this section;\n\n4. Solicits, accepts or conspires to solicit or accept new or\n\nrenewal insurance risks by or for an insolvent insurer;\n\n5. Removes, attempts to remove or conspires to remove the\n\nassets or records of the insurer or a material part thereof, from\n\nthe place of business of the insurer or from a place of safekeeping\n\nof the insurer;\n\n6. Conceals, attempts to conceal or conspires to conceal the\n\nassets or records of the insurer or a material part thereof;\n\n7. Diverts, attempts to divert, or conspires to divert funds of\n\nan insurer or other person in connection with:\n\na. a contract of insurance,\n\nb. the business of an insurer, or\n\nc. the formation, acquisition or dissolution of an\n\ninsurer;\n\n8. Solicits, accepts or conspires to solicit or accept any\nhe insurer or a material part thereof;\n\n7. Diverts, attempts to divert, or conspires to divert funds of\n\nan insurer or other person in connection with:\n\na. a contract of insurance,\n\nb. the business of an insurer, or\n\nc. the formation, acquisition or dissolution of an\n\ninsurer;\n\n8. Solicits, accepts or conspires to solicit or accept any\n\nbenefit in exchange for violating any provision of this section;\n\n9. Conceals, attempts to conceal, conspires to conceal or fails\n\nto disclose any change in any material fact, circumstance or thing\n\nfor which there is a duty to disclose to another; or\n\n10. Alters, falsifies, forges, distorts, counterfeits or\n\notherwise changes any material statement, form, document, contract,\n\napplication, certificate, or other writing with the intent to\n\ndefraud, deceive, or mislead another.\n\nD. It shall not be a defense to an allegation of a violation of\n\nthis section that the person accused did not have a contractual\n\nrelationship with the insurer.\n\nE. For the purposes of this section:\n\n1. “Contract of insurance” includes, but is not limited to,\n\nworkers' compensation insurance or any other means of securing\n\ncompensation permitted by the Workers' Compensation Act or\n\nreinsurance for such insurance or other means of securing\n\ncompensation;\n\n2. “Insurer” includes, but is not limited to, any person who is\n\nengaged in the business of making contracts of insurance;\n\n3. “Person” means any individual or entity, whether\n\nincorporated or not, and in the case of an entity, includes those\n\npersons directly responsible for the fraudulent actions of the\n\nentity;\n\n4. “Statement” includes, but is not limited to, any oral,\n\nwritten, computer-generated or otherwise produced notice, proof of\n\nloss, bill of lading, receipt for payment, invoice, account,\n\ncertificate, survey affidavit, book, paper, writing, estimate of\n\nproperty damage, bill for services, diagnosis, prescription, medical\n\nrecord, x-ray, test result or other evidence of loss, injury or\n\nexpense; and\n\n5. “Work” does not include activities that result in nominal\n\neconomic gain.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a8c5150bb74ecd94e870d9b7d17eb4a0e325e46777f0e135953427d7ca02a98d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1662","next":"us-ok/okla.-stat.-tit.-21-21-1671"},"notice":"GroundRules: Original legal text.
