Every person who is guilty of a felony under any of the\n\nprovisions of Sections 2, 3, 4, or 5 of this act shall be guilty of\n\na Class B5 felony offense and shall be punished by imprisonment in\n\nthe state penitentiary for not less than one (1) year nor more than\n\nten (10) years, or shall be fined not less than Two Thousand Dollars\n\n($2,000.00) nor more than Twenty-five Thousand Dollars ($25,000.00),\n\nor by both such fine and imprisonment.\n\nB. Every person who upon conviction is guilty of any of the\n\nprovisions of Section 6 of this act shall be punished by\n\nimprisonment in the county jail for not more than one (1) year, or\n\nshall be fined not more than Five Hundred Dollars ($500.00), or by\n\nboth such fine and imprisonment.\n\nAdded by State Question No. 687, Initiative Petition No. 365,\n\nProvision No. 8, adopted at General Election held on November 5,\n\n2002.
