Any person who, with intent to deprive or withhold from the\n\nowner thereof the control of a trade secret, or with an intent to\n\nappropriate a trade secret to his or her own use or to the use of\n\nanother:\n\n1. Steals or embezzles an article representing a trade secret;\n\nor\n\n2. Without authority makes or causes to be made a copy of an\n\narticle representing a trade secret,\n\nshall be guilty of larceny under Section 1704 of this title and\n\nshall be subject to punishment as provided for in Section 1705 of\n\nthis title. For purposes of determining whether such larceny is\n\ngrand larceny or petit larceny under this section, the value of the\n\ntrade secret and not the value of the article shall be controlling.\n\nB. 1. The word \"article\" means any object, material, device,\n\ncustomer list, business records, or substance or copy thereof,\n\nincluding any writing, record, recording, drawing, sample, specimen,\n\nprototype, model, photograph, microorganism, blueprint, information\n\nstored in any computer-related format, or map.\n\n2. The word \"representing\" means describing, depleting,\n\ncontaining, constituting, reflecting or recording.\n\n3. The term \"trade secret\" means information, including a\n\nformula, pattern, compilation, program, device, method, technique,\n\ncustomer list, business records or process, that:\n\na. derives independent economic value, actual or\n\npotential, from not being generally known to, and not\n\nbeing readily ascertainable by proper means by, other\n\npersons who can obtain economic value from its\n\ndisclosure or use, and\n\nb. is the subject of efforts that are reasonable under\n\nthe circumstances to maintain its secrecy.\n\n4. The word \"copy\" means any facsimile, replica, photograph or\n\nother reproduction of an article, including copying, transferring\n\nand e-mailing of computer data, and any note, drawing or sketch made\n\nof or from an article.\n\nC. In a prosecution for a violation of this act, it shall be no\n\ndefense that the person so charged returned or intended to return\n\nthe article so stolen, embezzled or copied.\n\nD.
