Stat. tit. 21, § 21-1742.3","heading":"Limitation on applicability of act","body":"No provision of this act shall be construed:\n\n1. So as to prevent any action by a law enforcement agency, or\n\nany officer, employee, or agent of a law enforcement agency, to\n\nobtain telephone records in connection with the performance of the\n\nofficial duties of the agency;\n\n2. To prohibit a telephone company from obtaining, using,\n\ndisclosing, or permitting access to any telephone record, either\n\ndirectly or indirectly, through its agents:\n\na. as otherwise authorized by law,\n\nb. with the lawful consent of the customer or subscriber,\n\nc. as may be reasonably incident to the rendition of the\n\nservice or to the protection of the rights or property\n\nof the telephone company, or to protect users of those\n\nservices and other carriers from fraudulent, abusive,\n\nor unlawful use of, or subscription to such services,\n\nd. to a governmental entity, if the telephone company\n\nreasonably believes that an emergency involving\n\nimmediate danger of death or serious physical injury\n\nto any person justifies disclosure of the information,\n\nor\n\ne. to the National Center for Missing and Exploited\n\nChildren, in connection with a report submitted\n\nthereto under Section 227 of the Victims of Child\n\nAbuse Act of 1990;\n\n3. To apply to or expand upon the obligations and duties of any\n\ntelephone company to protect telephone records beyond those\n\notherwise established by federal and state law or as set forth in\n\nSection 4 of this act; or\n\n4.
