Stat. tit. 21, § 21-1753.3","heading":"Throwing, dropping, depositing or otherwise placing","body":"litter upon highways, roads or public property - Penalties.\n\nA. The operator of a vehicle, unless any other person in the\n\nvehicle admits to or is identified as having committed the act,\n\nshall be liable pursuant to subsection B of this section for any act\n\nof throwing, dropping, depositing, or otherwise placing any litter\n\nfrom a vehicle upon highways, roads, or public property.\n\nB. Any person convicted of violating the provisions of\n\nsubsection A of this section shall be subject to a state traffic\n\noffense punishable by a fine of not more than One Thousand Dollars\n\n($1,000.00) and upon conviction shall be sentenced to perform not\n\nless than five (5) nor more than twenty (20) hours of community\n\nservice in a litter abatement work program as approved by the court,\n\nor the violator may be subject to criminal prosecution as provided\n\nby the provisions of Section 1761.1 of this title. The penalties\n\ncollected from the payment of the citations shall, after deduction\n\nof court costs, be paid into the reward fund created pursuant to\n\nSection 1334 of Title 22 of the Oklahoma Statutes.\n\nC. Any person convicted of violating the provisions of\n\nsubsection A of this section with any flaming or glowing substances\n\nexcept those which by law may be placed upon highway rights-of-way,\n\nor any substance which may cause a fire shall be subject to a state\n\ntraffic offense punishable by a fine of not more than Two Thousand\n\nDollars ($2,000.00) and, upon conviction, shall be sentenced to\n\nperform not less than ten (10) nor more than forty (40) hours of\n\ncommunity service in a litter abatement work program as approved by\n\nthe court, or the violator may be subject to criminal prosecution as\n\nprovided by the provisions of Section 1761.1 of this title. The\n\npenalties collected from the payment of the citations shall, after\n\ndeduction of court costs, be paid to the fire department of the\n\ndistrict in which the flaming or glowing substance was discarded.\n\nD. During a declared burn ban by the Governor, any person\n\nconvicted of violating the provisions of subsection A of this\n\nsection with any flaming or glowing substances except those which by\n\nlaw may be placed upon highway rights-of-way, or any substance which\n\nmay cause a fire shall be subject to a state traffic offense\n\npunishable by a fine of not more than Four Thousand Dollars\n\n($4,000.00) and, upon conviction, shall be sentenced to perform not\n\nless than twenty (20) nor more than eighty (80) hours of community\n\nservice in a litter abatement work program as approved by the court,\n\nor the violator may be subject to criminal prosecution as provided\n\nby the provisions of Section 1761.1 of this title. The penalties\n\ncollected from the payment of the citations shall, after deduction\n\nof court costs, be paid to the fire department of the district in\n\nwhich the flaming or glowing substance was discarded.\n\nE. As used in this section, “litter” means any flaming or\n\nglowing substances except those which by law may be placed upon\n\nhighway rights-of-way, any substance which may cause a fire, any\n\nbottles, cans, trash, garbage, or debris of any kind. As used in\n\nthis section, “litter” shall not include trash, garbage, or debris\n\nplaced beside a public road for collection by a garbage or\n\ncollection agency, or deposited upon or within public property\n\ndesignated by the state or by any of its agencies or political\n\nsubdivisions as an appropriate place for such deposits if the person\n\nmaking the deposit is authorized to use the property for such\n\npurpose.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6aa6e6b43506119119b41d19d1f1d0d0079f9dc51a02cac6c13f3d591df90373","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1753","next":"us-ok/okla.-stat.-tit.-21-21-1753.4"},"notice":"GroundRules: Original legal text.
