Stat. tit. 21, § 21-1792","heading":"Critical infrastructure facility - Trespass - Damage -","body":"Penalties.\n\nA. Any person who shall willfully trespass or enter property\n\ncontaining a critical infrastructure facility without permission by\n\nthe owner of the property or lawful occupant thereof shall, upon\n\nconviction, be guilty of a misdemeanor punishable by a fine of not\n\nless than One Thousand Dollars ($1,000.00), or by imprisonment in\n\nthe county jail for a term of six (6) months, or by both such fine\n\nand imprisonment. If it is determined the intent of the trespasser\n\nis to willfully damage, destroy, vandalize, deface, tamper with\n\nequipment, or impede or inhibit operations of the facility, the\n\nperson shall, upon conviction, be guilty of a Class D3 felony\n\noffense punishable by a fine of not less than Ten Thousand Dollars\n\n($10,000.00), or by imprisonment as provided for in subsections B\n\nthrough F of Section 20P of this title, or by both such fine and\n\nimprisonment.\n\nB. Any person who shall willfully damage, destroy, vandalize,\n\ndeface or tamper with equipment in a critical infrastructure\n\nfacility shall, upon conviction, be guilty of a Class D3 felony\n\noffense punishable by a fine of One Hundred Thousand Dollars\n\n($100,000.00), or by imprisonment in the custody of the Department\n\nof Corrections for a term of not more than ten (10) years, or by\n\nboth such fine and imprisonment.\n\nC. If an organization is found to be a conspirator with persons\n\nwho are found to have committed any of the crimes described in\n\nsubsection A or B of this section, the conspiring organization shall\n\nbe punished by a fine that is ten times the amount of said fine\n\nauthorized by the appropriate provision of this section.\n\nD. As used in this section, \"critical infrastructure facility\"\n\nmeans:\n\n1. One of the following, if completely enclosed by a fence or\n\nother physical barrier that is obviously designed to exclude\n\nintruders, or if clearly marked with a sign or signs that are posted\n\non the property that are reasonably likely to come to the attention\n\nof intruders and indicate that entry is forbidden without site\n\nauthorization:\n\na. a petroleum or alumina refinery,\n\nb. an electrical power generating facility, substation,\n\nswitching station, electrical control center or\n\nelectric power lines and associated equipment\n\ninfrastructure,\n\nc. a chemical, polymer or rubber manufacturing facility,\n\nd. a water intake structure, water treatment facility,\n\nwastewater treatment plant or pump station,\n\ne. a natural gas compressor station,\n\nf. a liquid natural gas terminal or storage facility,\n\ng. a telecommunications central switching office,\n\nh. wireless telecommunications infrastructure, including\n\ncell towers, telephone poles and lines, including\n\nfiber optic lines,\n\ni. a port, railroad switching yard, railroad tracks,\n\ntrucking terminal or other freight transportation\n\nfacility,\n\nj. a gas processing plant, including a plant used in the\n\nprocessing, treatment or fractionation of natural gas\n\nor natural gas liquids,\n\nk. a transmission facility used by a federally licensed\n\nradio or television station,\n\nl. a steelmaking facility that uses an electric arc\n\nfurnace to make steel,\n\nm. a facility identified and regulated by the United\n\nStates Department of Homeland Security Chemical\n\nFacility Anti-Terrorism Standards (CFATS) program,\n\nn. a dam that is regulated by the state or federal\n\ngovernment,\n\no. a natural gas distribution utility facility including,\n\nbut not limited to, pipeline interconnections, a city\n\ngate or town border station, metering station,\n\naboveground piping, a regulator station and a natural\n\ngas storage facility, or\n\np. a crude oil or refined products storage and\n\ndistribution facility including, but not limited to,\n\nvalve sites, pipeline interconnections, pump station,\n\nmetering station, below or aboveground pipeline or\n\npiping and truck loading or offloading facility; or\ns, a city\n\ngate or town border station, metering station,\n\naboveground piping, a regulator station and a natural\n\ngas storage facility, or\n\np. a crude oil or refined products storage and\n\ndistribution facility including, but not limited to,\n\nvalve sites, pipeline interconnections, pump station,\n\nmetering station, below or aboveground pipeline or\n\npiping and truck loading or offloading facility; or\n\n2.
