Stat. tit. 21, § 21-1834","heading":"Chattels encumbered by mortgage, conditional sales","body":"contract or security agreement - Removal or destruction.\n\nAny mortgagor, conditional sales contract vendee, pledgor or\n\ndebtor under a security agreement of personal property, or his or\n\nher legal representative, who, while such mortgage, security\n\nagreement or conditional sales contract remains in force and\n\nunsatisfied, conceals, sells or in any manner disposes of such\n\nproperty, or any part thereof, or removes such property, or any part\n\nthereof, beyond the limits of the county, or materially injures or\n\nwillfully destroys such property, or any part thereof, without the\n\nwritten consent of the holder of such mortgage or conditional sales\n\ncontract, secured party or pledgee under a security agreement shall,\n\nupon conviction, be guilty of a Class D3 felony offense if the value\n\nof the property is One Thousand Dollars ($1,000.00) or more and\n\nshall be punished by imprisonment as provided for in subsections B\n\nthrough F of Section 20P of this title, or by a fine of not to\n\nexceed Five Hundred Dollars ($500.00). If the value of the property\n\nis less than One Thousand Dollars ($1,000.00), the person shall,\n\nupon conviction, be guilty of a misdemeanor punishable by\n\nimprisonment in the county jail not exceeding one (1) year, or by a\n\nfine not exceeding Five Hundred Dollars ($500.00). Provided,\n\nhowever, the writing containing the consent of the holder of the\n\nmortgage or conditional sales contract, secured party or pledgee\n\nunder a security agreement, as before specified, shall be the only\n\ncompetent evidence of such consent, unless it appears that such\n\nwriting has been lost or destroyed.\n\nR.L. 1910, § 2755.
