Whoever shall willfully or maliciously enter the garden,\n\nyard, pasture or field of another after being expressly forbidden to\n\ndo so or without permission by the owner or lawful occupant thereof,\n\nor a person failing to leave lodging establishment premises pursuant\n\nto Section 508 of Title 15 of the Oklahoma Statutes, shall be deemed\n\nguilty of trespass and upon conviction shall be punished by a fine\n\nof not more than Two Hundred Fifty Dollars ($250.00); provided, that\n\nthis provision shall not apply to registered land surveyors and\n\nregistered professional engineers for the purpose of land surveying\n\nin the performance of their professional services; and, provided\n\nfurther, that anyone who willfully or maliciously enters any such\n\ngarden, yard, pasture or field, and therein commits or attempts to\n\ncommit waste, theft or damage shall be deemed guilty of a\n\nmisdemeanor and upon conviction shall be fined not less than Fifty\n\nDollars ($50.00) nor more than Five Hundred Dollars ($500.00), or by\n\nconfinement in the county jail for not less than thirty (30) days\n\nnor more than six (6) months, or both such fine and imprisonment.\n\n1. This provision shall not apply to:\n\na. peace officers as defined in Section 99 of this title,\n\nb. federal, state or local government employees engaged\n\nin the performance of their duties,\n\nc. firefighters, emergency medical personnel or public\n\nutility employees engaged in addressing an emergency\n\nthat presents an imminent danger to health, safety or\n\nthe environment in the performance of their duties, or\n\nd. parties engaged in oil and gas operations, which shall\n\ninclude, without limitation, exploration, drilling,\n\nproduction and sales activities, under authority of\n\nmineral ownership, an oil and gas lease, seismic\n\nagreement or permit, gas gathering, purchase,\n\ntransportation or treating contracts, Corporation\n\nCommission or other lawful authority from persons\n\nentitled to give the same;\n\n2. The provisions of this section shall not prohibit:\n\na. railroad employees and emergency equipment from\n\nentering such land to restore rail service following\n\nan accident, derailment or natural disaster,\n\nb. the entrance of utility employees or contractors while\n\nacting in the scope of their employment, or\n\nc. employees or contractors of valid easement or license\n\nholders while acting in the scope of their employment;\n\n3. The following persons may enter such land of another unless\n\nforbidden to do so, either orally or in writing, by the owner or\n\nlawful occupier thereof:\n\na. registered land surveyors and registered professional\n\nengineers for the purpose of land surveying in the\n\nperformance of their professional services,\n\nb. persons making a delivery, selling a product or\n\nservice, conducting a survey or poll, working on\n\nbehalf of a candidate for political office, or\n\nc. persons who have a legitimate reason for entering and\n\nwho, immediately upon entering, seek to conduct\n\nbusiness.\n\nB. Anyone who willfully or maliciously enters any such land of\n\nanother and commits or attempts to commit waste, theft or damage\n\nshall be deemed guilty of a misdemeanor and upon conviction shall be\n\npunished by imprisonment in the county jail for a term of not less\n\nthan thirty (30) days nor more than six (6) months, by a fine of not\n\nless than Fifty Dollars ($50.00) nor more than Five Hundred Dollars\n\n($500.00), or by both such fine and imprisonment.\n\nC. No provisions of this section shall be construed to conflict\n\nwith Section 5-202 or 6-304 of Title 29 of the Oklahoma Statutes.\n\nD. Whoever shall willfully enter the pecan grove of another\n\nwithout the prior consent of the owner or occupant thereof to so do\n\nshall be deemed guilty of trespass and upon conviction shall be\n\npunished by a fine of not more than Twenty-five Dollars ($25.00);\nge 839\n\nC. No provisions of this section shall be construed to conflict\n\nwith Section 5-202 or 6-304 of Title 29 of the Oklahoma Statutes.\n\nD. Whoever shall willfully enter the pecan grove of another\n\nwithout the prior consent of the owner or occupant thereof to so do\n\nshall be deemed guilty of trespass and upon conviction shall be\n\npunished by a fine of not more than Twenty-five Dollars ($25.00);\n\nprovided, that anyone who willfully enters any such pecan grove and\n\ntherein commits or attempts to commit waste, theft or damage shall\n\nbe deemed guilty of a misdemeanor and upon conviction shall be\n\npunished by a fine of not more than Five Hundred Dollars ($500.00),\n\nor by imprisonment in the county jail for not more than six (6)\n\nmonths, or by both such fine and imprisonment.\n\nE. Whoever shall willfully or maliciously enter upon property\n\nowned or managed by the Grand River Dam Authority without permission\n\nshall be deemed guilty of misdemeanor trespass and upon conviction\n\nshall be punished by a fine of not more than Two Hundred Fifty\n\nDollars ($250.00); provided, that this provision shall not apply to\n\nregistered land surveyors and registered professional engineers for\n\nthe purpose of land surveying in the performance of their\n\nprofessional services; and, provided further, that anyone who\n\nwillfully or maliciously enters upon property owned or managed by\n\nthe Grand River Dam Authority without permission and therein commits\n\nor attempts to commit waste, theft or damage shall be deemed guilty\n\nof misdemeanor trespass and upon conviction shall be punished by a\n\nfine of not less than Fifty Dollars ($50.00) nor more than Five\n\nHundred Dollars ($500.00), or by imprisonment in the county jail for\n\nnot less than thirty (30) days nor more than six (6) months, or by\n\nboth such fine and imprisonment.\n\nF.
