Stat. tit. 21, § 21-1847a","heading":"Using or allowing use of automatic dial announcing","body":"device - Exceptions - Penalties.\n\nA. Except as provided by this subsection, no person shall use\n\nor knowingly allow the use of an automatic dial announcing device.\n\nAn automatic dial announcing device shall be used only when:\n\n1. The device disconnects from the called person's line not\n\nlater than twenty (20) seconds after the called person hangs up; and\n\n2. For calls terminating in this state, the device is not used\n\nto make a call:\n\na. before 9 a.m. or after 9 p.m., or\n\nb. at any hour that collection calls would be prohibited\n\nunder the federal Fair Debt Collection Practices Act,\n\n15 U.S.C., Section 1692(c), when the device is used\n\nfor collection purposes; and\n\n3. One of the following occur:\n\na. the calls are made or messages given solely in\n\nresponse to calls initiated by the person to whom the\n\nautomatic calls or recorded messages are directed or\n\nwho has made a written request to be called,\n\nb. the calls made concern goods or services that have\n\nbeen previously ordered or purchased,\n\nc. the calls are made by creditors or their assignees, or\n\nd. the calls are initiated by a live operator who gives\n\nthe caller the option to disconnect prior to the\n\nplaying of a prerecorded or synthesized voice message.\n\nB. A person who violates any provision of this section is\n\nguilty of a misdemeanor.\n\nC. The Attorney General may seek injunctive relief to enforce\n\nthis section pursuant to the Oklahoma Consumer Protection Act.\n\nD. In the event that a civil action is filed pursuant to this\n\nsubsection, the prevailing party shall be entitled to a reasonable\n\nattorney's fee.\n\nE. A contract or agreement to purchase any goods or services\n\nfor sale executed in violation of the provisions of this section\n\nshall be voidable at the option of the person who has subscribed to\n\ntelephone services from a telephone company.\n\nF. For purposes of this section, \"automatic dial announcing\n\ndevice\" means automatic equipment that:\n\n1. Stores telephone numbers to be called, or has a random or\n\nsequential number generator capable of producing numbers to be\n\ncalled;\n\n2. Conveys a prerecorded or synthesized voice message to the\n\nnumber called; and\n\n3.
