Stat. tit. 21, § 21-1861","heading":"Information to be furnished by solicitor - Calls exempt -","body":"Penalties.\n\nA. The name and organizational or business affiliation of every\n\nperson who by telephone engages in the solicitation or sale of any\n\nitem, tangible or intangible, shall, by such person, be given to the\n\nperson answering such telephone call. Such information shall be\n\ngiven immediately and prior to any solicitation or sales\n\npresentation. The telephone number of the person placing the call\n\nmust be given upon request of the party being called. The person in\n\nwhose name the telephone is registered is responsible for his agents\n\nand employees conforming with the provisions of this section. This\n\nsection does not apply to calls between persons known to each other\n\nand to religious groups, or nonprofit organizations within their own\n\nmembership, and political activities.\n\nB. No person may solicit contributions by telephone for a\n\ncharitable nonprofit organization unless that organization has\n\ncomplied with the provisions of the Oklahoma Solicitation of\n\nCharitable Contributions Act, Sections 552.1 et seq. of Title 18 of\n\nthe Oklahoma Statutes. Such person may charge a reasonable fee for\n\nhis services, which shall not exceed ten percent (10%) of the net\n\nreceipts of the solicitation; provided, however, that in the event\n\nthe fee charged is based upon a predetermined flat fee, then this\n\nprovision shall not apply. Provided, further, that all sums shall\n\nbe paid directly to the nonprofit organization.\n\nC. Violation of this section by a person, business or\n\norganization shall constitute a misdemeanor.
