Stat. tit. 21, § 21-1870","heading":"Definitions","body":"As used in this act:\n\n1. \"Access device\" means any telecommunication device including\n\nthe telephone calling card number, electronic serial number, account\n\nnumber, mobile identification number, or personal identification\n\nnumber that can be used to obtain telephone services;\n\n2. \"Clone cellular telephone\" or \"counterfeit cellular\n\ntelephone\" means a cellular telephone whose electronic serial number\n\nhas been altered from the electronic serial number that was\n\nprogrammed in the telephone by the manufacturer by someone other\n\nthan the manufacturer;\n\n3. \"Cloning paraphernalia\" means materials that, when possessed\n\nin combination, could be used to create a cloned cellular telephone.\n\nThese materials include scanners to intercept the electronic serial\n\nnumber and mobile identification number, cellular telephones,\n\ncables, EPROM chips, EPROM burners, software for programming the\n\ncloned telephone with a false electronic serial number and mobile\n\nidentification number combination, a computer containing such\n\nsoftware, and lists of electronic serial number and mobile\n\nidentification number combinations;\n\n4. \"Electronic serial number\" means the unique number that:\n\na. was programmed into a cellular telephone by its\n\nmanufacturer,\n\nb. is transmitted by the cellular telephone, and\n\nc. is used by cellular telephone providers to validate\n\nradio transmissions to the system as having been made\n\nby an authorized device;\n\n5. \"EPROM\" or \"Erasable programmable read-only memory\" means an\n\nintegrated circuit memory that can be programmed from an external\n\nsource and erased, for reprogramming, by exposure to ultraviolet\n\nlight;\n\n6. \"Intercept\" means to electronically capture, record, reveal,\n\nor otherwise access the signals emitted or received during the\n\noperation of a cellular telephone without the consent of the sender\n\nor receiver, by means of any instrument, device or equipment;\n\n7. \"Manufacture of an unlawful telecommunication device\" means\n\nto produce or assemble an unlawful telecommunication device, or to\n\nmodify, alter, program, or reprogram a telecommunication device to\n\nbe capable of acquiring or facilitating the acquisition of\n\ntelecommunication service without the consent of the\n\ntelecommunication service provider;\n\n8. \"Mobile identification number\" means the cellular telephone\n\nnumber assigned to the cellular telephone by the cellular telephone\n\ncarrier;\n\n9. \"Possess\" means to have a physical possession or otherwise\n\nto exercise control over tangible property;\n\n10. \"Sell\" means to offer to, agree to offer to, or to sell,\n\nexchange, give, or dispose of an unlawful telecommunications device\n\nto another;\n\n11. \"Telecommunication device\" means:\n\na. any type of instrument, device, machine, or equipment\n\nwhich is capable of transmitting or receiving\n\ntelephonic, electronic, or radio communications, or\n\nb. any part of an instrument, device, machine, equipment,\n\nor other computer circuit, computer chip, electronic\n\nmechanism, or other component, which is capable of\n\nfacilitating the transmission or reception of\n\ntelephonic or electronic communications within the\n\nradio spectrum allocated to cellular radio telephone;\n\n12. \"Telecommunication service\" means any service provided for\n\na charge or compensation to facilitate the origination,\n\ntransmission, emission, or receipt of signs, signals, writings,\n\nimages, and sounds or intelligence of any nature by telephone,\n\nincluding cellular telephones, wire, radio, television option or\n\nother electromagnetic system;\n\n13. \"Telecommunication service provider\" means any person or\n\nentity providing telecommunication service including a cellular\n\ntelephone or paging company or other person or entity which, for a\n\nfee, supplies the facility, cell site, mobile telephone switching\n\nofficer, or other equipment or telecommunication service; and\n\n14. \"Unlawful telecommunication device\" means any\nelectromagnetic system;\n\n13. \"Telecommunication service provider\" means any person or\n\nentity providing telecommunication service including a cellular\n\ntelephone or paging company or other person or entity which, for a\n\nfee, supplies the facility, cell site, mobile telephone switching\n\nofficer, or other equipment or telecommunication service; and\n\n14. \"Unlawful telecommunication device\" means any\n\ntelecommunication device that is capable of, or has been altered,\n\nmodified, programmed, or reprogrammed, along or in conjunction with\n\nanother access device, so as to be capable of acquiring or\n\nfacilitating the acquisition of a telecommunication service without\n\nthe consent of the telecommunication service provider.
