It shall be unlawful for any person to knowingly and without\n\nthe written consent of the owner, transfer or cause to be\n\ntransferred to any article or sound recording or otherwise reproduce\n\nfor sale, any performance, whether live before an audience or\n\ntransmitted by wire or through the air by radio or television, with\n\nthe intent to sell or cause to be sold for profit or used to promote\n\nthe sale of any article or product.\n\nB. A violation of this section involving less than one hundred\n\narticles shall constitute a misdemeanor, and shall, upon conviction,\n\nbe punishable by a fine not to exceed Five Thousand Dollars\n\n($5,000.00).\n\nC. A violation of this section involving one hundred or more\n\narticles shall constitute a Class D1 felony offense, and shall, upon\n\nconviction, be punishable by a fine not to exceed Fifty Thousand\n\nDollars ($50,000.00), or by imprisonment as provided for in\n\nsubsections B through F of Section 20N of this title, or both such\n\nfine and imprisonment.\n\nD.
