This section shall be known and may be cited as the \"Laser\n\nSafety Act\".\n\nB. Any person who knowingly and maliciously projects a laser,\n\nas defined in this section, on or at a law enforcement officer\n\nwithout the consent of the officer while the officer is acting\n\nwithin the scope of the official duties of the officer shall be\n\nguilty of a misdemeanor and upon conviction shall be punished by a\n\nfine of not more than One Hundred Dollars ($100.00). Any person who\n\ncommits a second or subsequent violation of this section shall be\n\nguilty of a misdemeanor punishable by a fine of not more than Five\n\nHundred Dollars ($500.00), a term of imprisonment in the county jail\n\nfor a period of not more than six (6) months, or by both such fine\n\nand imprisonment.\n\nC. Anyone who knowingly aims the beam of a laser pointer at an\n\naircraft in flight or at the flight path of an aircraft shall be\n\nguilty of a misdemeanor and upon conviction shall be punished by a\n\nfine of not more than One Hundred Dollars ($100.00). Any person who\n\ncommits a second or subsequent violation of this section shall be\n\nguilty of a misdemeanor punishable by a fine of not more than Five\n\nHundred Dollars ($500.00), a term of imprisonment in the county jail\n\nfor a period of not more than six (6) months, or by both such fine\n\nand imprisonment.\n\nD. This section does not prohibit aiming a beam of a laser\n\npointer at an aircraft, or the flight path of such an aircraft by:\n\n1. An authorized individual in the conduct of research and\n\ndevelopment or flight test operations conducted by an aircraft\n\nmanufacturer, the Federal Aviation Administration, or any other\n\nperson authorized by the Federal Aviation Administration to conduct\n\nresearch and development or flight test operations;\n\n2. Members or elements of the Department of Defense or\n\nDepartment of Homeland Security acting in an official capacity for\n\nthe purpose of research, development, operations, testing or\n\ntraining; or\n\n3. By an individual using a laser emergency signaling device to\n\nsend an emergency distress signal.\n\nE. As used in this section:\n\n1. \"Laser\" or \"laser pointer\" means any device designed or used\n\nto amplify electromagnetic radiation by stimulated emission that\n\nemits a beam designed to be used by the operator as a pointer or\n\nhighlighter to indicate, mark or identify a specific position,\n\nplace, item or object; and\n\n2. \"Law enforcement officer\" means any police officer, peace\n\nofficer, sheriff, deputy sheriff, correctional officer, probation or\n\nparole officer, emergency management employee, judge, magistrate, or\n\nany employee of a governmental agency who is authorized by law to\n\nengage in the investigation, arrest, prosecution, or supervision of\n\nthe incarceration of any person for any violation of law and has\n\nstatutory powers of arrest.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"14f0e612f7f7b1b046ad88df02fbcd680cc5ec67d2dada0d23e891d990397fa5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-1990.2","next":"us-ok/okla.-stat.-tit.-21-21-1993"},"notice":"GroundRules: Original legal text.
